i am US citizen and want to apply for my husband as Permanent resident

I am US citizen and got my citizenship couples days ago.I want to apply for my husband for Permanent Resident.

My husband is Canadian resident and he is in US with me from June 2007 on F-1 visa as he is studying here.He has US SSN also.In June 2009 is our second marriage anniversary and we are trying to get CONDITIONAL GREEN CARD before that.I have filled forms I-130, I -485, G-325 A (from both of us but separately ,do we both need to fill this form).

But i am confused that for AFFIDAVIT OF SUPPORT which form i should fill ( I-864 or I-864 EZ)as i am homemaker from last two years and taking care of twins and all expenses are on his school loan.Except these two forms do i have to fill I-864 A also or my husband should fill because he is the one who annual household income supports all of us.I didn't fill tax return for 2007 and 2008 also,i thought didn't work so i dont need to fill.What should i do now for tax return of 2007 now as there is column for federal tax return income in I-864A for last two years.

Any kind of help will be appreciated.

Fill in the I-864. Not that much different.

You, the US citizen, should fill out I-864, or I-864EZ. Look at them and decide which you should use. One gives a place for listing assets, basically. Your husband should complete the I-864A since he, as the inteding immigrant, will be contributing ot the support of the family.

For 2007 and 2006 (I presume) state reported income as 0 (zero) dollars. You may also attach a letter explaining you did not work during that (those) years.

Privided your husband makes enough money for the familt, I do not think you have a problem. One thing, I presume your husband has some sort of work authorization if not a green card, correct?

You may want to consider finding a co-sponsor to ensure the poverty guidelines are met for your whole family. For your family of 4, his income would have to be $27,562. Difficult to do only part time I'd imagine.

yup..co-sponsor and how exactly does ur husband support you on his student loans..students on f-1 can only work up to 20 hrs a week , ON CAMPUS! F-1 students are not legally permitted to work off-campus, unless they filed for economic hardship..

Thanks.But do i need any particular form /application to mention that i didnt work during 2007 and 2008 or just a letter written by my own showing the reason .Yes my husband has work authorization.

You will have to fill in the I-864 affidavit of support, so will your co-sponsor, and if you're including your husband's income, he will have to fill one out too. You as the spouse would still be considered the primary sponsor, even though you have no income.

I used to make $23k+ (not a lot but quite good as a student) as a research assistant at graduate school. I was on F-1 as well. One of my friends at another Ivy (Cornell) was making 35k+ because his research was jointly sponsored by two universities.

Also, I believe spouse's income CAN be added to USC's income to prove overall income is above poverty.

Thanks Kumar, My husband has F-1 andI-94 visa till June 2009 and Tourist visa till 2012 and on student loan for a dental student from July 2007.we are in the limits of poverty guidelines.I didnt do job in 2007 and 2008and not file up the taxes of 2007.So his school loan is the source of income.Please tell me now which forms he should fill and which forms i should fill.

I am answering this from my very limited knowledge.

* I am not sure if the school loan can be considered a source of income -- ask that separately on the forum

* You definitely have to fill out I-864 even if you didn't make any money as you're the relative through which your husband is applying for the green card

* You should try to get a joint sponsor (ANY relative / friend) who makes enough money to cover your family, the joint sponsor, and joint sponsor's dependents (as mentioned on JS' tax returns) -- the poverty limits are not that high and hopefully you should be able to find someone to help. JS fills out I-864 as well

* If even with joint sponsor you don't meet the poverty limits then you can count your assets (home, second car etc) towards meeting the poverty limit -- read I-864 instructions for this

Overall, spend 30 mins going through I-864 instructions (http://www.uscis.gov/files/form/I-864.pdf) and you would have a better picture.
