Hi everyone - I have what may seem like a very complicated question, but I hope you will be able to help me.

In September 2008 I applied for a fiance visa (K-1) for my then boyfriend. We decided not to get married, and I sent USCIS a letter canceling the petition on December 15th. In February, to my surprise, I received a notice saying that my petition had been approved. I called USCIS and they told me to send another letter requesting the petition to be canceled, and I did so on February 12, 2009. On March 10, 2009 I received a letter from the embassy with an interview date for my former boyfriend for the fiance visa. I was very confused! -- and have sent a letter back to the embassy to request cancellation.

In all of this time of back and forth, I have met someone, who I want to marry (who, as just my luck is not a US citizen). Can you tell me how long I would have to wait to file a K-1 petition on his behalf? What the process would be if it is different? This has all been so confusing as I requested the cancellation so many months ago.

you cannot have two active petitions.... you need to make sure the first is withdrawn.... then you need to read about IMBRA.... which has a multiple filing limitation that needs to be overcome with a waiver request

When I was younger I would have asked for you phone number for my party list.

Make sure one fiance is finished before you start the next, no threeways!

It is more difficult for the petitioner to be swapping partners than the beneficiary, so be prepared for waivers and such.

It is more difficult for the petitioner to be swapping partners than the beneficiary, so be prepared for waivers and such.

Also, it's a "fiance visa" not a boyfriend visa. Anyway, we don't call the USCIS toll free number the misinformation line for nothing. Once the petition was approved, they should have told you to contact the Consulate as they already sent it on to NVC, through which it is routed to the Consulate usually within days. Since you've notified the Consulate of your intentions. You may file a new petition for another whenever you wish.
