Dear all,

We had our AOS interview last week and received a letter from USCIS today addressing to me (beneficiary). The letter writes:

Please come to the office shown below at the time and place indicated in connection with an official matter.

Office Location: xxxxx Non-immigrant unit/ Stokes

Date and Hour: xxxxx

Ask for: Any district adjudication officer

Reason for Appointment: I-130

There are two attachments indicated what to bring with us and our rights and previleges during this and any other I-130 adjudication proceeding.

Is this called the stokes interview? Why is this connected to I-130 instead of I-485 (as our interview was for I-485)?

Please kindly help.

Yes it is.

You may want to research this type of interview, so your prepared.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks. We thought everything went well. There was no request of further evidence or anything. We must say this caught us off guard. Does it make a difference whether the letter is addressed to me (beneficiary) or my husband (petitioner)?

I wouldn't think so.

Where you previous married? or your petitioner?

Most of what I read on stokes is that everyone recommends a lawyer to prep you and go with you to the interview.

What did they ask you to bring to the interview?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The petitioner is previously married before and applied for a K1 for another woman, whom he never married. Their case was abandoned eventually.

Proper ID

My passport and I-94 (which they took at the initial interview)

SSN card for both of us (which I don't have)

The beneficiary's children birth certificate (I don't have any children)

Marriage registration

Employment letters from both of our employers. The letter must state date employment began, salary, martial status, dependents claimed and whom to notify in case of emergency. The letter must be signed by an official of the firm. The latest two pay stubs/ statements must also be submitted.

Federal income tax return for the last year.

Any evidence to prove of a bona fide marriage

Passport photos

The reason for the appointment on the letter is "I-130 Application Filed By Spouse - Petitioner Must Be Present". It is my handwritings on the form because I have much neater handwritings from my husband. He was around and we worked through the form together. Do you think that may be what their reason "filed by spouse" mean?

Ok, I would also recommend he brings proof of the previous marriage/divorce certificate, and he should be prepared to answer questions about the abandoned K-1.

Lots and Lots of marriage evidence showing you two are married for "love" not immigration.

Good sign about passport photos - you will need those if they are going to issue you something.

You know, looking at the info in your first post, it does say Non-immigrant unit/ Stokes - so it might not be for a Stokes. I am not sure how they are set up there.

Hi Karin and Otto,

I put YES next to those we submitted or presented originals at the first interview:

YES - Proper ID

YES - My passport and I-94 (which they took at the initial interview)

NO - SSN card for both of us (which I don't have)

NO because I have no children - The beneficiary's children birth certificate (I don't have any children)

YES - Marriage registration

YES for my husband (self-employed). NO for me - Employment letters from both of our employers. The letter must state date employment began, salary, martial status, dependents claimed and whom to notify in case of emergency. The letter must be signed by an official of the firm. The latest two pay stubs/ statements must also be submitted.

YES & NO (1099 forms for 2008 presented at interview. My husband has not filed for 2008 yet) - Federal income tax return for the last year.

YES (letter from building to proof we live together, bank letter, cell phone letter, IRA form with my husband changing the beneficiary to my name, no utilities bills because they are included in the apartment building, photos) - Any evidence to prove of a bona fide marriage

YES - Passport photos

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Stokes is an interview procedure in the New York District Office that resulted from a lawsuit Stokes vs INS. So they have to follow certain procedures because of the judgement of the lawsuit, including recording (video or written transcript) of the procedings. Not too sure about all of this, but it may be just because your I-130 is in New York. It looks like that just might be a procedure they have to follow and not necessarily about your I-485 interview.

This cannot & shd not happen if you have provided enough proof of a bopnafide and ongoing marriage. NOw i guess you also came through K1. What happened at the 1st interview ? What did the officer ask that you cdnt reply or any fact that he was not happy about or grumbled about ? I saw the proofs you have already submitted. Did you submit anything like anything imp bought in both names, any activity proof that was registered in both name and do together ( like a GYM membership) , joint insurance , joint tax return .... things like that. These kind of proofs goes upperhand beyond pics. Was any recommendation letters were submitted ? And you didnt get any RFE during the process...

March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )
July 14th : Great Interview. All done in 20 mins.
July 18th: Online status - Card Production ordered. Thank God !! I-130 online status : Pending
July 23rd : Welcome to USA & I-130 approval letter recieved. Online status still shows pending.
July 31st : Received conditional green card

3/25/11 - Received reminder from USCIS to file for ROC
5/6/11 - Sent I-751 Packet to CSC via usps
5/9/11- Package delivered to csc.
