I want to SINCERELY thank ALL VJers who responded to my post ... thank you ... you guys are wonderful, all information given was useful.

If it weren't for the fact that I have a business I would move to Nigeria to be with Stephen (that will prove the relationship is bona fide). Anyway, I am asking for your advise, if all fails (already submitted the paperwork to my Senator's office for his assistance), should I return to Nigeria, get married then file an I-130. Can anyone who's filed an I-130 give me their timeline for that process. Also, would that have a negative affect because I filed a K-1 and it was sent back.

I can't believe I spent so much money on an Attorney (found out about visajourney AFTERWARD) and when I called her today to inform her of the denial, she was out sick! She's always out sick ... Unbelievable!

Hello,

When you marry, be sure to make sure that all processes necessary for your marriage to be considered legal in Nigeria take place. After your marriage, you should petition to bring your spouse to the US. You should file both the I130 form and the I129f. File I130 first. after you receive the receipt, file the I-129f and send the receipt. Be sure to provide all proof of your relationship and bonafide marriage, marriage certificate, emails, gift receipts, airplane tickets, pictures, have some of his friends and family as well as your friends and family write up a statement attesting to your relationship and stating when they became aware of the relationship, how they know you or him, and their general feelings about the marriage and have them notorized. Include these with your proof.

Several thing will happen. You will get an approved I129f first, an approved I130 first or they may both get approved around the same time. You have to keep in mind that the I129F is a nonimmigrant visa, so if your I130 is not approved right away, your husband can apply only for a K3 nonimmigrant visa. You will need to adjust his status and seek permission for him to work once he arrives in the US. This can be costly and adds some more paperwork and waiting into the mix but if you want him in the US with you and you do not have an approved I130 you will have this option.

If your I130 gets approved, you can either choose to wait a little longer for the processing of a CR-1/IR1 visa which is an immigrant visa or you can apply for the K3 visa.

The CR-1/IR1 visa will allow your husband to work as soon as his SSN arrives in the mail and you will not have to go through the process of adjusting his status, saving you money and grief. Some people choose to abandon the I129f if their I130 is approved first and then apply for the CR-1/IR1 visa.

I myself am just starting out in this process and I have married a Nigerian man. Although we did not marry in Nigeria, I think you will get better results from the consulate in Nigeria once the two of you are married. But I would advise that you plan to be there with him when he has his interview.

I am sorry that you are having to basically start this process all over again.

Before you marry make sure that your K1 petition is expired. They will not consider your CR1 if your k1 is still active.

You paid all that money for her legal assitant to fill our your paper work. She really did nothing, but review your documents (hopefully). I had the same problem. I got half my money back though.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi MrsJibowu, I would go back to marry in Nigeria after all else fail. My K-1 expires May 30, 2009. Stephen went back on Thurs, Mar 26th and after putting up much of a fuss and them attempting to literally THROW HIM OUT of the embassy, he remained FIRM and the embassy finally gave in and gave him an Inquiry form to fill out and told him to come back on Monday, Mar 30th for his next interview date.

He said he told them that he saw (as he was coming in) Scammers laughing (because they just got their visa) and here he is, TRUE, and they have him coming up there (for a second interview) as well as him crying out to God on his behalf, he said he told them it just wasn't right. Stephen commented to me that he's former military (more than 20 years service in the Nigerian army) and never had the military knock him down (emotionally) like the tactics of immigration!

Lord's will I plan on being there for the next interview.

What reason was given for denying the K-1 visa? Did he tell you? Certain reasons for denial would apply also to any other visa application from the same person.

For some reason this question came to my email so I don't think the original poster received it or saw it, but in another post I believe she stated that her K1 was denied because the interviewer didn't believe the relationship was real.
