Well, I would only need that for the Interview, right? I still need to submit my application.

not really. i followed the guides and i submitted that info with my application. needless to say i was approved in 3 months. is that why i got apporved so quickly? maybe not, but it most definitely made things much easier. check out the guides. there is a detailed section.

I came here as K1 and am not applying for I-130, only I-485(AOS), I-765(EAD), and I-131(AP). I've read the guidelines and it only requires Evidence of a Bonifide Marriage when you're applying for I-130. But I'd still provide those evidences for our Interview cos for the I-485 alone, it doesn't require those documents until the Interview.

yeah i feel you...i mean u don't have to provide any evidence at all when u filing, but i just thinks it helps alot when u do.. s oi was just passing that along...good luck.

No evidence of bondfide marriage is expected when filing for AOS. It doesn't make any sense for AOS. Some K-1s get married after being here for 5 days so say married in 5 days and then filing for AOS on day 10, how could anything be established in just 10 days? Where bonafide is a priority is during removal of conditions.

During AOS, K-1s are without an SSN and a drivers license. I won't even attempt to put my wife's name on anything when most agencies/companies/whatever are going to want an SSN and/or some proof of legal residency. Without a SSN, drivers license, legal residency, it is very difficult to do anything in this country.

Some people do not have an AOS interview (not sure what the percentage is), because K-1s have just recently been cleared by the embassy and so to clear a person (relationship) yet again only months later is overkill. They wait until removal of conditions for the true love, true marriage evidence.

They give a two year green card so people have time to prove the marriage is real..... this is why a 10 year green card isn't given from the get-go.

i only realised that the OP was k-1 after my first response...and if you read the post you can see the extent of the conversation....i really dont get where u coming in with this post....the conversation was long done my friend!

that truly makes sense but what do u think about my case? am here at the US for 9 months now? i have my SSN and we already have joint bank account? do u think i need to provide evidence of bonifide marriage together with the documents that i'll be submitting for the application or just bring it for the interview if i'll have (i hope not :P )?

Personally, I don't think you need any evidence. If you have it and it is easy to produce, it doesn't hurt, but I really think at AOS, they could care less about the evidence since they will catch up to you when you remove conditions. This is the whole purpose of the removal of conditions part of the deal.

AOS just gets you in a holding cell... you aren't home free until you get that 10 year card and they know it. At Removal of Condition, this is when the evidence is really important.

I'm going to file this week (my wife is). The only thing I'm doing that is overkill is my I-864. I've not filed 2008 taxes yet so I only have 2007. I'm going to submit some pay stubs and a letter from my employer to prove I'm still employed (important thing to do these days).

i only have the utility bills for now but we can easily request for joint bank account statement (i guess), so i dont have all of em on hand right now and am planning to submit early this week.

DEDixon, u also need to provide a letter of explanation why u were not able to file for next year. i guess u already know that already. but i just wanna make that u know it :blush:

I'm not sure about TX, but here in CA, it is just a matter of going to the county clerk's office to get a certified copy of the marriage (in CA, it is a certified marriage certificate and license together all on one document). If you aren't local nearby, you can call them, they can most likely take debt or credit card for billing. Once you get the certified version, you can copy and send.

Phone bill, electric bill... trivial because you can't work so you can't pay so they know it is just for show... you can't be responsible for the bill if you have no income. When you get to Removal of Conditions.... things that are really important are things like leases, mortgages, health insurance, joint checking account/savings, beneficiary of life insurance, car loan(s), joint car insurance..... of course pictures in as many places as possible in as many different clothing as possible and you can even ask your friends to sign an affidavit which states your marriage/relationship is genuine. (no need for yahoo chat log or texting logs or long distance phone records... LOL!)

In Texas you get a certified copy from the County Courthouse where you purchased the Marriage License. For a certified copy, they basically will make a photocopy and affix a seal or embossment on it. Normally they will have a stamp that says something like "I certify this is a true copy....." and the clerk signs her name to it and dates it. Each county will have their own process, seal, etc. Ours is like they reduced the copy machine to print a slightly smalller version on the same fancy paper the original is on, but that left space to do their embossing of the county seal and signature at the bottom.

And to add my opinion to your other question about including relationship proof. You're K1 and have already proven your relationship to USCIS with an I-129F petition. That stuff will be sitting in your file to join up with you AOS application for the reviewing officer to see. You have already been interviewed in person about your relationship. The same is true for K3 married applicants. That's why K1/K3 do not send additional relationship evidence at this point. The people adjusting who were already in the US are submitting their first thing ever to USCIS, so do need to support their I-130 petition along with the AOS requirements.

Start gathering evidence as you can of comingling assets and joint residence in the event that you interview for AOS. The interviewer likes to see joint bank accounts, both names on insurance, leases, credit cards,etc., some photos of wedding or photos with family, and perhaps mail addressed to Mr/Mrs at the same address. It doesn't have to be all of that, but whatever you are able to show. And if your case is transferred to California, you won't have an interview, but right now that is taking way longer than the people who go to interviews. They act like they are transferring to fast track you, but that's currently the slow-track. Maybe it's that getting all those K1s off to CSC made more room for the others to get a faster interview at local offices.

Thanks for the replies.

I just got the certified copy of marriage certificate earlier. I searched on About.com on how to obtain it and that's where i got the info that the local country clerk can provide it. I went to our country clerk's office and only paid $6.00/copy. Got 2 copies, for me and my son since he is adjusting from K2 as well.

Yep, I'll start collecting our bank statements (joint), land title in both names, insurance, mails, etc. I'd rather have the interview if I'll get it faster with that route. But I can deal with whatever route I will be as long as we're approved. :thumbs:

No passport photocopy for the USC. The AOS application is all about the non USC for the most part. USC only provides the I-864 and of course the marriage certificate is joint.

No passport photocopy for the USC. The AOS application is all about the non USC for the most part. USC only provides the I-864 and of course the marriage certificate is joint.

That's what I believe and I looked on the I-485 instructions itself, it didn't list down the USC passport so I don't think I needed it. Maybe just for K3.
