I don't know if this question has been asked, but I'm sure it has. There are so many posts here, it's difficult to find it so I'll start a new one.

My fiancee wants to visit me here in the U.S. She already has a tourist visa. Right now, I'm at the NOA1 stage. If she visits me at this time, will this affect any outcome of my K-1 application? Does anyone have this experience?

K-1 Progress:

I-129F Sent: 03/09/09

I-129F Received by CSC: 03/11/09

NOA1 Notice date: 3/12/09

NOA2 Notice date: 6/24/09

NOA2 Hardcopy: 6/29/09

NVC Received: 6/30/09

NVC Sent to GUZ: 7/6/09

Yes, she can visit you without it affecting your petition. In fact, a visit may help you prove a bona fide relationship at the interview.

3.15)...Can I, while my fiancee will apply for a I-129F package, be with her in the US ? So we can stay together while the application is being processed or do I have to go to back home again ?

As long as you do not go beyond your visa expiration date and leave in plenty of time to do your part of the application then it should be ok. Many couples file the I-129F while the fiance(e) is in the US. However, the visa application itself is accomplished in the fiance(e)s home country, so the fiance(e) must return home to complete the visa application process and the interview at the US Consulate. So the bottom line is that you should follow all USCIS rules if you are here int he US and if your visa requires you to return home on a certain date that you do so on time.

Thanks for the info. It makes everything more reassuring. Also, thanks for the tip. I'm still learning a lot about this site!

Perhaps we need a FAQ on using the FAQ? :jest:

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
