Form I 864 or I 864 EZ?

Hello all!

I am doing DCF in madrid Spain. Last week I turned in the I 130 Form and they gave me a checklist for immigrant visas. I understand everything except the I 864. My parents are going to sponser me since I do not meet the guidelines. Here are my concerns:

1.) We both have to fill out the I 864 not I 864 Ez right???

2.)On the first part of the I 864 I should check (a) as the petitioner, and my parents should check (B) affidavit of support correct?

3.) Can my parents email me the completed I 864 or should they mail it to me?

Yes, you are correct. If you have a joint sponsor, you cannot use the EZ form. Check with your embassy on the email copy. I am almost certain they will want the original. Better to have the original than risk getting an RFE. You check the "petitioner" box on your Affidavit. Your parents check box e or e, whichever applies to them.

All incorrect.

1) You need I-864 and your parents need I-864A (The signatures on the I-864A must be notarized by a notary public or signed before an immigration or consular officer). No need to notarize I-864.

2) On I-864 form you check as petitioner and on I-864A sponsor check part1, question # 8C and then box “parent”.

3) Need original completed forms (no e-mail versions).

02/17/2009: I-130 NOA2: Approved in 210 days from NOA1 date

I-129F (K-3):

08/11/2008: NOA1

02/17/2009: I-129F NOA2: Approved in 190 days from NOA1 date

<not pursuing I-129F petition further but NVC forwarded case to Consulate on 02/24/2009>

02/19/2009: NVC Received/Case number assigned for I-130

02/20/2009: DS-3032 sent by e-mail and 03/04/2009: DS-3032 sent by regular mail

02/26/2009: NVC received DS-3032 Choice of Agent selection

02/26/2009: DS-3032 accepted and AOS Bill Generated but not IV Bill

02/28/2009: AOS Bill Package received in mail

02/28/2009: Paid AOS Bill and IV Bill (as it was available) online

03/03/2009: Both AOS and IV Bill Show as Paid and Coversheet Printed

03/04/2009: Mailed I-864 and IV (DS-230) Packages

03/06/2009: I-864 and IV Packages Received by NVC and Scanned on 03/10/2009

03/13/2009: Case completed at NVC (in 17 working days from date NVC Received)

03/25/2009: Interview date assigned by NVC

US Consulate @ Mumbai, India

04/02/2009: Medical Exam (based on NVC e-mail for interview)

Sorry, this is wrong. First, to the OP -- your parents are not sponsoring YOU, they are sponsoring your spouse. Second, both you and one of your parents will complete I-864s; you are both acting as joint sponsors for your spouse. If you are filing DCF, you are most likely not living with your parents and are not part of their household, ergo it would be inappropriate for both parents to complete an I-864A. If both parents would like to be part of joint sponsorship, one parent would complete the I-864 and the other the I-864A. Neither the I-864 nor the I-864A no longer require notarization -- this was changed in 2006. See here: http://travel.state.gov/visa/immigrants/info/info_3197.html

Also, for your second question regarding which box to tick for the basis of filing the affidavit of support:

You check box "A" or your I-864 and your joint sponsor (the one completing the I-864) checks box "E" on his/her I-864. The parent completing the I-864A checks box "C" on question 8 but the answer is NOT parent but "other dependent" -- the parent is not sponsoring YOU, but your spouse, so the answer to fill in is "son-in-law" or "daughter-in-law" as appropriate.

I concu (again). Your parents fill out the I864 (not the 864A, as mentioned, that is only if you reside in the same household)

Well, only my father will sponser my wife...In thhat case he needs to fill out the I 864 not the I864A correct??? And which box should he check E or C? :)

Fill up I-864, he needs to send you the real one as NVC will not take an e mail version. Goodluck!
