Stll under AP!!!Got excited for nothing!!!

well guys iam still under AP....i got excited for nothing coz i got my passport back today with no visa stamped on it....(thats made me cry and my wife)....

well i called DOS today and they said embassy is asking for my daughter's birth certificate and her passport(She doesnt have passport)....

well my situtaion is very bad...i talked to my wife and she couldnt stop crying....well god is playing good game with us,,and we are very depressed..and very frustated..but we not gonna loose hopes and we will never give up.....but i pray to god my AP gets over asap....

But should i wait from embassy to send me the another 221g letter for asking more documents or should i go and submitt them personally......im confused...please help me coz iam in very bad situtaion..and cannot see my wife struggling over there in US with our daughter,,,,...............................

Technically she is not my daughter.., my wife has her from her ex-boyfriend.....and u can say im her step dad....well why they askin for that information,,,,,im soo depressed,and confused,...help me..

i have one quick question for u ,at the interview did u mention ur the child actually ur step doughter or ur biolagical doughter?

Yes i did mentioned abt daughter at the time of interview... Well if i send my documents straight to USE.. They wont accept it.. They need me to submit those documents at VFS but VFS wont take any documents without a request letter from embassy.. I mean another 221g letter..

2 month ago i called DOS and they told me that they need my husband travel history,,i right away emailed USE and indicated what DOS told me,and then they replied to me right away which normally they dont reply to any emails ,,so email them and they will reply within an hours aslo ask them to to sent inform VFS to ecapt ur documents

i dont know wats goin on!!!!

well i called embassy today and they said you have to sumbit documents for ur daughter,,,,and do not hide anything from us and disclose everything to us...

i feel like i did some crime or something...it really hurted me,.....Do u think its a sign of denial......i dont knw what to do,,,im big time confused....feel like im gonna lost everything,....we contacted our congressmen too and lets see wats gonna happen ,,,??..help me god.... :crying:

Stop carrying on and take a deep breath. If the child is not yours, why do you keep saying 'my daughter'? Is this the term you used during the interview, to refer to the child, "my daughter"? If so, the consulate is quite clear to request the birth certificate and/or passport to verify the facts. Since, as you say, the child is not yours, submit a copy of the birth certificate and a letter written by your wife (she is the petitioner) explaining that the child is not yours, and is from a previous marriage/relationship. That should be sufficient.

Ken86! did u write abt ur step daughter in ur biographic page?

If u wrote then, i think u did a mistake in ur biographic G 325a Form.

Well my wife has also daughter from her ex husband.I did not write any thing in my bio graphical page.But my wife did.At the time of interview in embassy they did not ask anything abt my step daughter.

So ken just calm down and give them what they r asking?

It sounds like they think you've claimed her as your biological daughter. Not good, since they are going to see on her Birth Certificate right off that she is not biologically yours. How did you present it in the interview? Did you call her "my daughter?"

First emt103c is right it seems like u claimed her as your daughter.Which was not right.

Second thing is that you should not wait the embassy letter if they emailed u or told u over the phone that which documents u will have to send then you should send those documents asap.

well they have asked for the child's birth certificate and passport and they will not process ur case untill they recieve them, and once they recive these two ducoments then they will work on ur case but i am very sure they will send ur case back to USCIA for missrepresentation regarding the child that u mentioned in ur interview that she is ur daughter and have them review it again this will take very long time and may end up in denying the case,i have read many case about miss representation and they were given a denial on their case or sent back to USCIA.

the best way for u not send birth and pasport and hire a lawyer to work in ur case,,,or conselt with a lawyer and see what are ur options ,,i am not sure but i m thinking if u withdraw ur case now and let it expire then reaply all over again so evry thing will be new and u can prpare correctly cuz in withdraw the case u have much stronger chance tp get aproval the next time but with denial it is very difficult to reverse it,there is one lady on VJ she is very expert and full of knowlage about immigration i advice u to chat with her am sure she will guide u to the right track and how to act ..i will get her nick for u soon

I have been reading over your AP and was surprised when you got the passport back without the visa inside. It does happen sometimes but now other issues are coming to light.

This is good that you have an elected official to maybe help with your case now. Be aware that once a congressional representative starts talking with the embassy then the embassy will usually not respond to you personally. The elected representative is the go between. How old is your wife's daughter? I think you stated maybe she was your daughter and they are wanting proof of whom the father is? I do not see it as big of a an issue if they verify the paternity and date of birth on the step-daughter. Couples marry all the time and the kids are brought up and discussed at the interview. My husband was asked about my son's and how he accepted them when he had his IV interview a few years back.

I also agree with Minya's wife on submitting the documents once you get the letter and make sure to enclose a reply from you stating that the child is not your biological child. That you are calling her your daughter since you married her mother. Make it all clear in your submission.

A consult also with an immigration attorney that deals with Indian cases would not be a bad idea as well. I know you were stressing out about the AP and they cannot help with security checks but in the case of the options with this petition it might be helpful.

Fire w wind is wrong in stating to not comply with the embassy request since this is a marriage visa I-130. Any issues that come up in prior petition(s) will be brought up once again when it is refiled. Also, not trying to get this approved and issued would be a red flag to me if wait and refile. Everything that happens with your files will remain with that file. A resubmission would need the original file number in the documents so you would just be extending the processing by not addressing this now.

1. Calm down and make a plan of action.

2. Draft your letter concerning the paternity of the child.

3. See if the congressional staff will be able to talk to the embassy since you have already contacted them?

4. Make sure you have the documents ready to submit to USE.

5. Consult with an attorney and see if they see an issue? It would be worth the little investment to ease you mind.

Hopefully, once you submit he documents they will be able to continue processing with your case. Also, be aware that if you still endure AP it could be for security checks.
