Hey. We got married, my wife changed her name at the SSA, and we tried to change her name at the DMV today. They said they can't do it because her i94 expired.

We already filed the AOS, and received the notice that they received it and will schedule her for biometrics soon.

What can we use to proof to the MVD that she is here legally. We are in phoenix, AZ.

Do we need to wait for the greencard, or can we use EAD, or can we use something like AOS NOA1?

Hello, I'm from Tucson AZ. May be the rules and regulations for the MVD in Arizona would be the same. I applied for my AZ driver's license using my NOA1 but they most likely wants to see and get the copy of your Biometric Appt. I took my NOA1 and Biometric appt when I went there in MVD. They only took the copy of my biometric appt letter and a copy of my Canadian passport as well as my Canadian driver's license. If you can wait, your EAD card will suffice the requirements.

So you mean a copy of the paper that says when the biometrics appointment is? That would be nice.

A lot of states will not let you get a driver's license unless you have a green card or other long term visa that allows you to live in the US. Google your state's DMV to look up what their laws are regarding immigrants and driver's licenses.

She may have to wait until she has her EAD, or even green card, before they'll consider her "legal"

Not a problem but standard procedure nowadays... Just go to the AZ DMV website an find out what they consider acceptable ID docs.... when you have them then go back

We had the same problem in California. Except the I-94 wasn't expired. But it was due to expire in less then 60 days so they wouldn't accept it. =/

Looks like in Cal you need to wait till you get your EAD.

I also had this problem of getting my drivers license when my I94 has expired but I have filed AOS. The DMV in CO sent me to a special office in the city with all my paperwork. They sent off copies of this and had my immigration status verified within a week. I was able to go back to DMV today with the verification and all my documents again and proceed to get my temp license. Go with all your documents to DMV and they will soon tell you what to do. Good luck!

NY is one of the worst States in terms of rules and regulations. Since i recently had to go through all of this, I experience might be of some help. Your EAD and NOA1 for I-485 should clear your Status. Most states(as in NY) also require a SSN Card in order to issue a DL. Your NOA1 will be enough to establish your legal status in the US.
