RFE at NVC ... original documents needed.

Well my case has been delayed again because of my lawyer, another negative point of using an immigration attorney. I still don't regret using him because of the high fraud that goes on at Vietnam US consulate and people getting lawyers cause of failed interviews there. I didn't want to take my chances and not have a lawyer from the beginning and fail. Well my lawyer sent my wife's birth certificate and our marriage certificate as a copy along with the power of attorney and he thought was enough. They alerted me that they needed the originals, I would have thought it was enough because I heard from someone that you should never send orginals of those type of documents because they might lose them. Also they needs 2 more passport pictures of my wife with her name and case number written on the back of them. I thought that they had her passport pictures of the I-130 process. I guess I was wrong.

Anybody ever had this same thing happen? How long did it take them to complete the case after they recieved the proper documents? This kind of sucks because I was hoping to have my wife in the United states before May. I don't know how much longer it could take for me to get her interview.

I am going through the same phase as you. We also had a RFE at NVC for my Wife and Sons case as my Immigration lawyer had asked me to send Photocopies of their Birth Certificates and also my Marriage Certificate and PCC. I called NVC on Fri and spoke to a Rep and she informed me to send them the Originals of these documents and also extra passport photographs and everything should be good. NVC Recieved my case on March 9th and they had already reviewed it by the 11th which is 2 days. If I would have had the correct documents im sure it would have been completed by now. I think it usually takes a max of 5 working days for them to review after you send in the RFE checklist documents. They just scare you and use the max time when they say it take 4-6 weeks to process. Average time is 7 days. Even I regret using an immigration lawyer. But im glad we did because he was a great help on the I-864 as I didnt meet the income requirement. Hope all goes well for ya!!!

Dai_VN did you/your wife get a police certificate yet?? What is it called in Vietnamese and where/when do you go to request it?? I'm trying to tell my husband over there to request a Phieu Ly Lich Tu Phap but he doesn't know what it's called or what...can you help if you've already gotten it??

He lives in District 12.

Linda, my wife got her police certificate from the same exact place where you get your marriage certificate (So Tu Phap). Just tell them you need Phieu Ly Lich Tu Phap and they will automaticly know what it is. It usually takes 3-4 weeks to get it and it only cost 100,000 dong. It's really easy to get.

do the original documents need to be legalized/certified (after translating and notarizing them, of course)? do they need the apostille seal or is that only if you send copies of the originals? im kinda confused at this point..... :unsure:

Write it with pencil is better, do not press so hard.

Does anyone know how long it usually takes for the RFE letter to get to my lawyer or me. They said it was generated and sent March 12 but Neither me or my lawyer haven't receive the letter yet.

It was probably dropped in the mail on Monday, so your lawyer should be receiving it today or tomorrow.
