We had our Green Card interview at the end of January and we've not heard anything as of yet. We have a little over 90 days now before his work permit will expire. Anyone had to file for an extension to the work permission while waiting for the Greencard? If so - can you tell me the process and if $$ are involved? Any help is appreciated.

05.02.2008 - Sent AOS & EAD package to Chicago.

05.04.2008 - Package recieved in Chicago.

05.09.2008 – Received NOA's.

06.04.2008 - Biometrics appt.

07.25.08 - Work Permission Received in Mail

07.28.08 - Applied for Social Security Number

08.04.08 - Received Social Security Number in Mail

09.29.08 - Started job

01.29.09 - AOS Interview

No fee, just file another I-765 to renew EAD based on pending I-485, you can even e-file this.

You would have to file for a renewal EAD and the fee is $340
:no: NO FEE for renewing an AOS (I-485) based EAD. Unless renewing an EAD that was filed for BEFORE Jan 30 2007.

Question for you:

- What did the Interviewing Officer told you? Were you told that you are approved? Did the Interviewing Officer told you that your card will be in process and that you should be recieving it soon?

If your case (I-485) is pending then you can file for EAD without fee. If you want to be sure about this, read the instruction on how to file the EAD.

I have a pending I-485, I filed for EAD extension (category c-9) January 24, recieved at the USCIS Jan 26 and then had my biometrics schedule Feb 27(taken). There should be no fee if application is based on pending I-485. I confirmed this process with an Immigration Officer at the USCIS when I went for INFOPASS appointment. At first, I was getting different information regarding the fee because the Immigration Officers have different interpretation of the instruction but then I went ahead and submitted by application for EAD extension and then it turned out to be fine since I had my biometrics schedule taken without the fee.

I believe, the USCIS will not process your application for EAD extension if they are to approve your AOS or green card.

- Be sure to know exactly what is the status of your AOS.

Good point, I would Info-Pass and ask about status of AOS, If it is approved, they will not renew an EAD. If AOS is pending something they should renew EAD.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Sounds like you have a long time (3 months) before you have anything to worry about. I'd imagine you will hear something by then.

As far as the link highlighted above, that is a completely different scenario. It is in regards to the initial K1 visa interview overseas. The US consular officials are very strict overseas during the K1 and K3 interviews. In the above case the non US citizen was working for 3 months without an EAD card. Whoever started the thread did not specify if he/she was on a work visa and their EAD expired or if he/she was on a tourist visa working illegally. Who knows what happened with them.

During the K1/K3 medical interview, if you so much as tell the nurse you tried weed one time in your life they automatically ban you for 3-5 years. There have been a lot of people on this site who hadn't smoked weed or sniffed cocaine (or whatever drug) in over 10 years. There was no way the drugs could be traced: not by blood, not by hair, not by urine. For some odd reason these people rose their hand and said "Yes! I tried weed a couple times! Once I did cocaine when I was 14! My senior year in high school I tried mushrooms!! Any other questions?" These honest Abe answers earned them multi-year bans.

My point is your case and the above are totally different scenarios. Plus you have a lot of time before you need to be biting your nails.

Do you have any more interviews in the near future or are you just waiting on something to arrive in the mail? If you don't have any further interviews and are simply waiting for the green card then I would continue to work; even if there was a 1 month or 2 overlap. There are over 10 million ILLEGALS in this country that are working ILLEGALLY. There are hundreds of thousands of green cards issued annually. The government is not going over each file with a fine-toothed comb to see if their is a 5-day gap in the time your EAD expires and the time you get your green card. Continue to work.

If I am not mistaken, Yu and Dan wrote in another thread that it is the employer's job to make sure your paper work is up to date---not the employee.

First call NVC & ask about your post-interview status. If they are still processing it, file I-765 on-line based on I-485

pending with NO FEE. Btw, do you check your I-485 status on-line? GOOD LUCK !.....

The post you have quoted has nothing to do with the renewal of a EAD. Please ensure the information you are giving people is acurate for their situation.

There is enough bad info out there as it is.

The only thing that the officer said was that we will be hearing something within two weeks on her answer if it's approved or not.

I would make an infopass appointment before you do anything else. You should have had a decision by now.
