Timeline

Ok Chris and i officially withdrew out K1 petition on Tuesday this week.

So whilst we are free for the clutches for a few days we got ourselves a marriage license for VA on Monday and intend to wed over the weekend, then next week will be reapplying for a CR1 to the USA and a Spouse Visa to Australia.

The Chief of staff at the DC office believes we have rights to expedite our case for the US, which is exciting, Chris just has to take our NOA1 number down to him when we get it. Good God I hope we get this one.... But on that note he seems to think it will only take 2 months. But Ive been told this story before so Im wary of the if its true or not lol. The Aussie one is meant to take 4-6 (however only 4 is most of the stuff is collected, medical, police check, etc before you file) So fingers croosed that this means either way we will be back together by March next year. Frankly it doesn't really matter which country this occurs in.

Wish me luck :) And keep me posted on how everyone is doing. I want to be here when We can finally Cheer for Marm getting spat out of that blackhole....

04-03-2009 Refiled K1 Visa application complete with expedite due to USCIS error.

05-14-2009 K1 package once again has vanished....

06-08-2009 Hired lawyer to proceed with Appeal process.

06-26-2009 Paperwork Fedex'ed to lawyer

07-02-2009 Lawyer submitted our suit to court

07-17-2009 Court day 2: Success, must respond by 21st August. - No result ever came from this.

10/06/2009 Withdrew K1 petition

10/10/2009 Married

10/24/2009 CR1 packet completed and posted

10/26/2009 Packet arrived at Chicago - And Submitted our Aussie application

11/04/2009 Application of CR1 returned - was rejected because of a "blurry zip code" we didn't bother to re-apply given that Chris had lost his job

04/05/2010 Australian application still pending

September 2010 - Chris arrived in Australia on Temporary Visa.

10/10/2011 - 2 year wedding anniversary - Chris to be granted Australian Permanent Residency

Summer 2012 - Planned immigration to USA.

*We have visited each other 8 times since 2007*

I don't think there is much chance of getting the CR-1 any faster than the fiance visa, I'm under the impression that whatever the hangup with a k-1 is, you'll probably hit it with a CR-1 visa too, but I just heard on the radio yesterday that australia is something like the second best country to live in, and the US... around 13th place... I don't know how reliable that information is but hey, you might end up having a step up on the rest of us when the big australia immigration rush kicks in (you know, from bankrupt america to australia)... I hadn't been into VJ for so long the site forgot to keep me logged in, me and the wife been busy and got a sinus infection, also a car, but she's still working with a learners permit and sadly after having the car for about a week she's only driven it about 20 feet (to park it in a better parking spot). I'm hoping that'll change tonight and she'll get some serious driving practice in now that we're both getting over the infection.

Anyway, did I somehow miss the court required answer from USCIS? Last I knew they had continued the run around, seriously, I can't believe nothing came of that? If they answer now they'll probably just state that they can't approve the petition because it was withdrawn (even though that happened way later).

I don't think they'll get the same hang-up with the CR-1 as it's a totally separate visa. People have been told before that their case was lost or stuck in something, and had better luck with the second filing. It's exciting that he seems to think it can be approved in a couple of months, I really hope that's true.

Goodluck Mara & Chris, and I also agree with Gemmie, your CR-1 is very likely to go through the system easily. As getting married and filing a petition again usually has better results according to a lot of the info provided by people in similar situations on VJ. We wish you the best as always! :star:

Chris and I are getting married on Saturday at 4 in his Dad's garden :). Sadly I dont have my wedding dress, but his sister and I are going to go shopping tomorrow to find me something nice to wear.

Im really excited about it now :)
