What is considered Employment ...

I have a question ... My fiance and I arent really bothered about me getting work asap and if nature takes its course my job for the next few years will be raising our family (were both old  in our late 30s and the clock is ticking  )

Anyways ... I like volunteering and have been volunteering here for years now whenever Im not working .... what do they consider employment on the K1? ... would a volunteer job be considered employment or does money etc have to be exchanged for it to be considered employment ...

Another thing is we have been discussing for a couple years about starting our own cafe/restaurant we want it to be our business and not get anyone else involved .. again as above I wont be working fulltime when we have a family but since I have a background in office work I can still do the ordering, bookkeeping etc and even help out 3-4 hours a day during the busy hours ... how strict are they when it comes co-owning businesses or property ... can we start making plans before the AOS or will we have to have the AOS before anything like this can be even considered...

Thank You :)

Employment = pay

If you get paid, and you have enough to meet the income requirements, you are gold.

If you don't, you will need to get a sponsor or have enough assets to cover the income level.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You do realize that there are financial considerations to getting a visa?

:) Im the beneficiary not the petitioner ... My fiance income is above the requirement and is working full-time...

Here is a link to the income requirements:

I-864P 2009

If it's just the two of you, the requirement is $18,212.00 (depends where you live, states, alaska, or hawaii)

I'm thinking your not military.

If your income meets that level - your good to go!

if not - get it, or sponsor, or get assets to cover it.

Then your employment or lack thereof is inconsequential.

ETA: OR do you mean employment for the purposes of filling out the G-325A?

 Thanks guys! Yeah I know I dont need to work but I want to find something to amuse myself! Im a city girl going to a small town of 1100 with no public transport or shops or gym or anything! and Im thinking of volunteering some time at the nursing home where Grandma (Shays) spent her last few years with Alziemas ... they were soo kind to her that I thought Id volunteer some time as a companian going in to read and keep the old folk company ... I just wasnt sure if that would be considered employment even thou I wont be receiving any money for my time ...

You probably need to read ahead a little bit....

Like down in the Living in America forum (or whatever it's called).

Before you have your greencard (if you have no EAD) you need to be careful about volunteering. Read up on it. I believe that if you are strictly doing something that cannot be perceived to be interning, you'll be all right.

After you have your greencard you are good to go.

Its going to be strange to have so much time on my hands, Im used to being busy atm Im doing volunteer work at a Salvation Army Relief Centre and it keeps me busy a couple times a week...

My husband volunteered in our city government for 3 months before he got his green card and he's been volunteering since he arrived at a non profit that does taxes for low income people. He's listed both of these volunteer positions on the forms he's subsequently sent to the government and has never had a problem.

Thank you, it gives me more confidence that I can do something a couple days a week without worrying ...
