I did not know about DCF

I filed my I-130 with VSC October 08. I was unaware of DCF until December 08. I called the embassy in Manila and know that I qualify to file DCF. I am flying back to visit my wife in 2 weeks. I am tempted (and wondering if) I can go ahead and refile DCF. Yes...I know (or hope) that at this point, my timeline is short at VSC, but, I am thinking...why not? Let the race begin! and...I am tired of waiting for VSC to get off their ####### and do thier job..sheeesshhh...and my lawyer told me.."we r getting K3 approvals in 2-3 months now"..what planet is he living on? Welcome to VSC. Any comments or suggestions? pls

Are you aware of the residency requirements for DCF? By what you said above it sounds like you are living in the US, not the Philippines....?

You cannot qualify for DCF unless you reside abroad, for more than 6 months, at the time of filing.

I have had a residence in the philippines since June 08. The embassy was satisfied with the lease, utilities, joint bank and credit accounts.

I know that in a number of other countries they are strict about one's physical presence in the preceding 6 months to qualify for DCF but if the embassy in Manilla is satisfied with your proof of residency & decide that you qualify then that's great.

Have a look at some other people's timelines on here and if it does work out to be quicker than waiting for VSC, I'd go ahead and switch to DCF

Yes..they seemed confused but said..if I was willing to pay the fees..then...was ok..but not confident..the logic seems...that i wud have 2 withdraw the first petition and start again?

You would really need to cancel the current petition in order to file the I-130 again in Manila. If you don't have I-130 approval yet, it would probably worth a shot!

EDIT - Oh! I see you're actually going for a K3. Doing DCF would be sooo much better than the K3! She would have an IR1 visa (or CR1 if you've been married more than two years upon her arrival in the US), which would give her a temp green card (real one would take a couple months to arrive but the temp does the same thing) and the ability to work right from the day she arrives!

Well, if you filed for K-3, you can certainly file DCF for IR1/CRI at the same time and have them run concurrently. You just can't have two peititions for the same visa running concurrently. Alot of people in the US file for both, then they abandon the one that takes the longest time. File for the DCF, and if it proves to be faster, then ytake the steps to abandon the K-3. I do not know the actual steps for abandoning, maybe someone else can tell you.
