I am adjusting from B1/B2 visa based on marriage to my wife who is uSC. I have a 1 yr valid multientry B1/B2 visa which is valid till March,09. BUt I have overstayed the departure date stamped by the POE officer by 8 months. So this will bw sent with I-485 and etc etc.

A) Regarding I-131

1) Address shd be one in usa /.... right ??

2) Class of Admission : shd be B1/B2 right ??

3) Part 2 which one to tick ?? a/b/c/d/e/f ?

4) Part 3, Page 2 : Intended Date of departure - what to write as i dnt know yet

5) Part 7 " for how many trips " - what to write ?

6) what are the documents to be attached with these forms... i read the instructions. 1stly they are so confusing and they say to attach photcopies my alien`s passport & I-94...is that enough ?

B) Also wanted to know which USPS service did Vjers use to send it to chicago lockbox and what was the approx cost of posting ?

I know i shdnt go out of usa unless i get my GC but then again i want to get it anyway in case of any emergency at home.

All help will be highly appreciated. Thanks a lot.

As far as I know you may as well not even bother applying for advanced parole, being on a tourist visa with an overstay you definitely do not want to take any chances leaving the country until you have a greencard in hand.

i must agree with the previous poster. u should steer clear of the AP since u already overstayed. i noticed that the different agencies do not always work in sync so even with the AP u could still run into numerous problems when trying to re-enter.

Emergency or not DO NOT LEAVE THE US without having your GC in hand. Whether they send you the AP or not, if you leave without having you GC you will spark a Ban period as you overstayed you initital Visa.

Why is it that the only one who can stop the crying is the one who started it in the first place?
