How to give evidence for 125% poverty line?

Hi all:

I just registered and this is my first post. Got married last week! :P My husband is a citizen and I began to prepare for application to greencard. Have a very hard question here: I know that we need to provide evidence showing that we can live without the governmennt support. The thing is: On his side, he works in a family business and he didn't make much because of the economy last year. (way less than $17000, if that is the correct line for 2-member family). On my side, I am F-1, accepted a job offer as a nurse starting August (I guess this not count). We don't have enough savings to show that we don't need support for 5 years. His mother has some money and may be the co-sponsor. What I should do? We have two cars, but someone said money is more important than assets. I guess I could understand.

SO.........I read the first article on the top about the application process. So helpful. THank you everyone!

Oh, almost forget, one more question. Do I need my husband's US passport copy to apply? Do I need his birth certificate (he was born in China)? I know I will need his approval of citizenship.

2/19/2009: JD became an US citizen!!

4/17/2009: AOS package sent through USPS Priority Mail

6/5/2009: Fingerprint done

6/8/2009: RFE received asking for tax info and employment letter from sponsor

6/11/09: RFE response send out via USPS

6/17/09: case resumed.

Bottom line, if he has proof that he is 125% poverty line like assets (checkings, savings, W2's, paystubs) he can support you financially; if he doesn't have proof, get a co-sponsor and be done with it.

income needs to be 125% or above, it is the W2 total earnings for the year that counts. If you are going to use assets such as savings etc.. they must be liquid assets firstly (i.e. a car is not an asset) and there are certain restrictions (i.e. 5x the amount needed or something).

In short you would be better with a co-sponsor if his income does not meet the requirements

09/16/2008 - Received notice for biometrics appointment on 09/30/2008

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

03/06/2008 - Welcome Letter received (the website will clearly never send me updates!)

A car can be an asset, if you have two of them. You can use one of them to support your asset case.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

If you can and have no problem with getting his mom to be the co-sponsor then that will be the way to go.

You will need your husbands US passport to apply since he was born outside the US. You will also need the original birth certificate and an officially translated copy if it is in any language other than English (or American)

01-27 : we went to dinner on a hot caribbean island

2008

09-07 : decided to get married

09-11 : walked to City Hall in NYC and got married

10-07 : sent in the mega package

2009

01-02 : EAD was received in the mail

02-25 : AOS interview - APPROVED!!!

I have my birth certificate, do I need his birth certificate as well??

A co-sponsor could be any American citizen. I had my best friend co-sponsor me and my wife because im still in school and I had my interview today with no problems.

You will need your husbands birth certificate (original and a copy) when you go for your AOS interview but not when you apply so you have time to get them

2006

Minor correction, Liquid asset just need to be 3 times the amount needed, not 5.

Thank you so much! This is really helpful on the birth certifiate! I do need his US passport copy, right? So the co-sponsor must be US citizen? His mom is permanent resident........ What about asking his mom to transfer some money to our account?
