Last night I started to really worry again about the fact that we still have not received our NOA2. Our wedding is only 5 weeks away and according to the USCIS website our case is still PENDING. Here is a brief history of our case (timeline has more detail):

2/06 Received NOA1

2/06 Received letter from NVC

4/06 Received K-1 visa in Rio

5/06 POE at JFK

6/06 Received Social Security card in the mail

Now, I called USCIS in March and April to check the status but I always got the standard "Call back in 30 days". Once we received the visa interview date, I decided just to let things go for a while because I didn't want to "rock the boat" since our case since it was all ready in Rio. We were approved for the visa but it took almost 2 weeks for it to arrive (I thought oh no, the no NOA2 caught up to us during that time). We had no problems at the POE (except it took a while for a Portuguese translator to arrive). Received the SSN and card in 6 days after applying.

Now that Elaina is here, I have written letters to my Senators but I am still waiting for a response (it has been 2 weeks). I have called USCIS 3 more times but we all know that it is difficult to get any answer from them. The only thing they told me that sometimes cases are approved and sent to NVC without updating the computer. The only other response I get is to call back in 30 days while they look into it.

Has anyone applied for and was approved for AOS without their NOA2? If yes, what did you send? Any suggestions or advice would be very helpful.

Thanks. I looked at that thread but my case is a little different. According to USCIS, my case is still pending and never has been approved so no NOA2 was ever issued. I don't think I can get a of something that was never issued in the first place but I could always try.

You applied for AOS without getting married?

Or are you still trying to get an NOA2 on a K1 Visa that you already have so that you can file for AOS?

06/10/06 Mailed AOS papers

07/06/06 Biometerics Apt

07/15/06 My offical wedding day....I know .....:-)

09/26/06 AOS Interview (Recommend for Approval)

10-05-06 Received Welcome Letter

I want to be able to apply for AOS and AP as soon as we are married in July. I am just starting to get everything in order now.

The NOA2 I am trying to get is from the orginal I-129F application. The case was approved without being entered into the computer so no NOA2 was created.

I meant to say..... I don't think I can get a COPY of something that was never issued in the first place but I could always try.

If the NOA2 was never issued, how did Elaina got in the US???? The consulate needs the petition approved to even have an interview.

Of course your petition was approved, and you just didnt get your NOA2 in the mail (and online).

Call USCIS and tell them you never received yours and you want a copy, but they may charge you the $200 fee for a new copy...

Ok I get it... Never mind...

I dont lol. How is he getting married after applying for AOS?...

he wants to apply for AOS very soon AFTER he marries in July, he is just trying to get the docs in ordcer now. Sounds like a good idea with the NOA2 mishap he has :(

I called USCIS yesterday (this was my 6th call concerning my NOA2) and according to their computer my case is still pending. The person I talked to found out my case was approved, sent to NVC, but never entered in the computer. From what he said, this happens about 10-20 times a year (I guess I am one of the lucky ones). Now that our packet is back in the US, they SHOULD be able to get the information to issue the NOA2. Now I just have wait and see what happens. The only good thing is Elaina is here with me as we try to figure this all out.
