Divorce after receiving conditional greencard

Hi,

I am currently married to an US citizen. Last October we had our AOS interview. One month later we replied to an RFE and two weeks ago I finally received my greencard.

But there is one problem now. During the last two months my wife and I had lots of trouble and we decided to divorce as fast as possible.

But I am afraid that we will get problems by USCIS if we file for divorce in the month I received my greencard or the month later.

So my questions are:

Does USCIS get notice about our diorce or the filing of it?

If yes, do they maybe consider marriage fraud?

If I divorce now, does it have an impact on my actual greencard (expiry in jan 2011)? I would like to stay one more year in the US and then go back to Europe.

What do you suggest?

I know it would be easy to wait some more months but it's both our feeling to leave everything behind as fast as possible. That's why we want to finish the divorce as quickly as possible.

I would be glad about some advice.

NO :no:

If yes, do they maybe consider marriage fraud?

YES :yes: the shortness of marriage will be a BIG factor when you go to file an I-751 to remove conditions. They will think that you married ONLY to immigrate and get residency in the USA.

If I divorce now, does it have an impact on my actual greencard (expiry in jan 2011)? I would like to stay one more year in the US and then go back to Europe.

NO impact on the CR-Green-Card's expiration date.

What do you suggest?

I know it would be easy to wait some more months but it's both our feeling to leave everything behind as fast as possible. That's why we want to finish the divorce as quickly as possible.

I would be glad about some advice.

if u only wanna stay one more year and the GC expire in 2011 u can stay here until this date and go back to europe and send the GC back...but if u wanna come back from europe u have to file removal of conditions...if u have only a short marriage u will have problems then
