Citizenship for a baby

Hi guys, we need advice.....my fiance and i have a two years old baby, our son born in Guatemala a year before he became a USC , so we cant get a USC passport or a USC birth cetificate here in Guatemala Embassy, we are in a k-1 visa process righ now and the baby was added, the question is: what is the next step to our baby when we are in the united state? how or what my fiance have to do for the AOS of his son?

You have to file for AOS for the baby also. $1010 for you and $600 for thr kid.

Separate I-485 and I-864. No need G325A for the baby.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

This mean our baby will be first a temporal resident, then a permanent, and 5 years later a USC ? it means nothing that his father is now a USC? :blink:

Since he is the biological father and hopefully on the birth certificate, he doesn't have to adopt the child. I think, all they have to do is file form N-600 after they entered the States. Since the child is younger than 18 and its father is a US citizen, the child automatically receives US citizenship.

yes, he appear like his father on the birth certicate, so fill the N-600 is the right way? i read in the link that USCIS dont work anymore in cases like this? or i'm confuse?

That's the only info I have about this topic but of course I'm not a lawyer and I'm not in your situation. I think it might be a good idea to contact the US embassy in your home country and ask them about advice.

O.k. I re-read my link. It says that the child has to be younger than 18 (which is the case), has to have a US citizen parent (which is true) and must have entered the States as an immigrant (your child needs a visa for that). So go and talk to the US embassy and apply for the according visa for your child. After he/she has entered the US, he/she does not have to met the naturalization criteria but will become a citizen "automatically" (after you filed N-600) because he/she has a US citizen parent.

De lo que entiendo de este sitio, parece que cuando tu hijo entra los EEUU con la visa (talvez K-2? no estoy segura de que tipo) y ya que tiene menos de 18 años de edad y que su papa ya es ciudadano, cuando entra con la visa ya va a ser ciudadano automaticamente. Esta informacion viene del sitio y dice que solo UN padre tiene que ser ciudadano, no los dos. Espero que te haya ayudado!
