If my k-1 was sent back to csc for review from the consulate and me and my finacees want to go ahead and get married is it possible for me to request that the k-1 petition be withdrawn and then i will file for cr-1 or k-3...

Send USCIS a notarized letter stating you are cancelling your petition.

Success of your second petition depends a lot on why your fiancee was denied the first time!

The reason lots of K1s are denied is lack of a bona fide relationship. Easy to overcome if you marry.

Do not cancel the first K1. That will make whatever reason they returned it get entered into the computer as fact. Depending on which center you went through you may get a notice of denial or it just vanishes into the petition closet. You need to address whatever the embassy had trouble with in your next petition or in the rebuttal. If you cancel the first petition you have a much harder time the next time.

There's no magic cure for a denied petition. The reason must be dealt with one way or another. It is on record.

Why was the visa denied?

Dear friends

K3 petitions expire four months from the approval date; this petition expired on July 10, 2008. The consular officer has the discretion to re-validate K3 visa petitions if they expire during processing; however, as the consular officer was not convinced of the relationship in this case, the petition was not revalidated. The application was returned to the National Visa Center (NVC) on January 13, 2009. Once NVC receives the petition, it will return it to the approving office of the United States Citizenship and Immigration Service (USCIS). Please direct all future inquiries regarding this case to the approving USCIS office.

I provided alot of pictures or combined maritial items to make them think you are really married. only problam was my wife came india once after marriag. we married in 2006. do u think it would be the reasion.
