I would try to go there because she's got job when I've not one legal now in Italy...so I have the chance to move without to be worry. But your advise is the best and more sure thing to make and I'll take that in a very good consideration about to solve the situation.

With me coming there witch are the options that we could have?

What do you mean? You do not have a job or do not have a legal job?

The fact is that you are not the first or the last person to meet his/her significant other via the internet, and feel in love. At this time, you do not qualify for any visa that would allow you to decide to stay if you marry while here. As an Italian citizen, you do have the right to use the VWP, but only to come to visit the US. Using the VWP for immigration purpose is not allowed. If as you say, you have no job in Italy, take a vacation and come see your woman. If she fears her ex-boyfriend, the two of you could meet in another city, or you can stay in a hotel or with friends rather than staying at her house.

Once you've met and spent time together, you can go back to Italy, and she can file a K-1 visa. In less than a year, you will be back here with a visa that is expressley made for the beneficiary to come to the US and marry his/her fiance(e). Do not speculate on what if, and can it be done? There is no visa for what you want to do...come here see if you two are really meant to be together and if so,...to stay.

You actualy have it easy in comparison with some others here....as the VWP is only for select countries. Others, who live in countries that do not have this program, must come up with other alternatives to meet.

Good luck,

-P

I think the OP has already decided that his best option is to come here on VWP and marry his girlfriend, as evidenced by his defensive attitude. He is just looking for validation and acceptance of his decision, though he has been told that is the incorrect and illegal thing to do and other posters have given him options. Obviously, those options are not to his liking, so why are we beating a dead horse?

Let's do a couple of scenerios:

1. You come on VWP to visit a lady you met on the internet. You stay with her for 2 months and you fall so deeply in love, you don't want to leave. You get married, you stay. She files I-130 and I-485 (concurrently you file for AP and EAD). So you are adjusting status. This is a loop hole in the law and it is done quite often, but ... At the interview you have to convince the officer, that when you came here you did not have any intention to stay (so you still have your bank accounts, your place to live, your utilities, your car, etc. in your home country!). You can not leave US after filing until you receive AP (look in the guides for all the abbreviations).

2. You come here on VWP to visit your gf. You deeply fall in love. You start filing for a K1 (you can start the process while you are still in US!). You stay for the time allowed, you return to your home country, after 2 months you come again for a visit. The whole process of a K1 you being from Italy will probably take 6 to 7 months and you can come to visit on VWP. You have to be in Italy for your interview at the embassy. After receiving your K1 visa you sell everything you have, cancel utilities, etc. and leave your home country to immigrate. You marry before 90 days after your arrival, you file for AOS, AP, EAD ...

This is a legal way, it will take a little longer and you will be seperated for a while.

3. See 2 but you get married and leave the country before your VWP expires and file for K3 or CR1/IR1. Interview in your home country. Advantage of CR1/IR1 you get your green card automatically after arrival. Takes a little bit longer than K1. You still can visit on VWP.

This is also legal and will not arise questioning.

Not being together with your gf yet at all and thinking about marrying her after being with her for 2 months ... I am not sure how this will look. And you might do something that is not well thought of. Marriage is marriage and especially being from a different country it will take time to adjust (believe me I know what I am talking about and I am from Europe originally, too). Going the K1 route will also give both of you some time to know more of each other when being together and then being apart again.

My husband and I were thinking about different options too and even different lawyers suggested scenerio 1 but always with the disadvantage of not being able to give up your home, job, car, etc. before moving here. So we decided on the K1. It is a clean way.

Hope this helped.

Wishing you luck.

Sib

If I were you, I'd consider opening a new thread if you have more questions. Asking what you did in the first few posts of the thread will derail all further discussion because nobody can appear to condone fraud.

Start a new thread with a blank slate...
