I would not be too sure, The K-1's non-immigrant status expires 90 days after arrival at POE. After the 90 days, the only reason you can still file for AOS is for "Technical Reasons", and you are out of status until the USCIS recognizes that you have filed for AOS ('c)(9)

filing "c(9)" has nothing to do with the I485/AOS.

From I-765 Instructions, 6. A. and 7. A.

:huh: right, thanks but I know where c(9) comes from, having filed for 3 of them.

c(9) still has nothing to so with actual AOS or the form to file it - which is what you said. Filing an I765 is optional.

Yes it is a section, one for an eligibility category for filing an EAD.

i don't think it is. if you read her replies from other's comments, she's willing to give evidences to those who doubt that she just made up the story.

OK, but the way I read that is:

10. Who Is Not Eligible To Adjust Status?

....you are not eligible for adjustment of status if any of the following apply to you:

F. You failed to maintain your non-immigrant status, other than through no fault of your own or for techincal reasons, UNLESS you are applying because you are:

iii. A K-1 fiance who married the U.S. petitioner within 90 days of admission.

Which tells me that if you are a K-1 holder who married your petitioner within 90 days of entry you are eligible to adjust status EVEN IF you fail to maintain non-immigrant status. Right??

Right. That is the technical reason. There is no deadline in the law, when your eligibility expires.
