Wellllllllll just spoke to my lawyer, shes drafting up the seperation agreement this week to attach to the divorce documents for next week. She said that if its in the seperation agreement that Im moving to the U.S, and that John will watch the kids while I get settled, then its a legal document and he has to follow. I wonder if its in the sepration agreement I can use that at the consulate

I find this whole thing confusing.. you had a restraining order against him but now you trust him to stay with your kids while you relocate to the US. You want his money but by moving geographical distance that is SUCH a distance he will have limited contact with them (especially with the military schedule he holds), so he'll pay money but have no access. You say his mother said he wasn't ready for kids, but um... men often aren't, but yet you are cutting off his ability to ever learn how to be with his kids by moving them to a new country and giving them exclusively to your new man to raise. You said the kids are too young to understand being away from their daddy, so they are going to be moved. You say your new man is someone even your parents want to influence your children, but if he is not set on encouraging & fostering the current relationship they have with their father, he is not a man of character IMO.

It doesn't add up. Not at all.. and I'm sorry, I for one think you are rushing this whole thing. I understand you want nothing to do with your ex husband at all. I get that.. you are divorcing him, but he has a right and a responsibility to his kids and it feels and looks (from what limited info I have) that you are going to take away the opportunity for him to grow into the role. I hope you have thought through the consequences of what you are doing because when your kids are older they will ask the questions about why you moved them, why they never saw their father and you will have to explain. I do hope that in an effort to end the relationship with their father that you are not jumping out of the frying pan and into another fire entirely..

*please note I am living this from the other side/ perspective.. and there may be some transference happening here, but I also feel I would be remiss not bringing some of this stuff up.*

Yes, there was the restraining order. I dont fear my children being with them, if I did, I would not leave them here alone with him. The reason there was a restraining order had nothing to do with the children. He's never hurt my children.

But grr, I wrote a bigger post and lost it all. Ill have to re-do it after I make the kids lunch

The thing is, when it comes to kids, even if he agrees to something now he can fight to prevent the move later. Agreements can change. And in the current climate, many courts will prevent children being taken far enough away to prevent access. Emmancipation makes a lot of good points, too and some of them would provide your soon-to-be-ex with a lot of ammunition against a move as it could be seen as too soon and call into question your judgement on what is best for the children.

You cannot ever prepare yourself for the heartache you will go through in not being with your children. And they will feel likewise. At such a young age, it is their needs and best interests which should be put first. I wish you well in making the right decisions.

i just want to add that if he agrees to watch the kids while you get settled, before your ready to come get the kids if he changes his mind and takes you back to court while your in the states it will be alot harder to fight him. It maybe be better to take the kids right away if he agrees you can always lower child support to help balance out the cost of visits.
