The check list of I-864 form (page 11) states that all sponsors must submit copies of tax return, including W-2s, as well as "each and every Form 1099".

When I was filing for I-129F and I-134, the general advice was if I had sufficient income, I should not list things such as stocks/bonds to avoid unnecessary complications. So this time while I was filling out I-864 form, I followed the same rule and only listed one bank where most of my savings are, and didn't bother with other banks and stocks/bonds.

But, if I am required to submit *every and each Form 1099*, would that cause discrepancy because I-864 doesn't have other accounts? Or is it still okay? Please advise. Thanks.

you would provide 1099's for Misc Income (if simply going the income route).. If it is too cumbersome, just get transcripts and be done with it...

YMMV

I cannot get the transcript because this is the 2008 tax return I am referring to. The original forms are still sitting on my desk waiting to be mailed out... so I can only submit xerox copies. just bad timing, I guess.

Also I am not sure if I follow the "Misc Income" answer - 1099 forms are for interests and dividends and they belong to "assets" under I-864.

Basically my question is, can I choose not to list certain secondary bank/investment accounts on the I-864 form even though 1099 forms will show them all? Please advise... thanks.

If you read your tax form before mailing it says

Attach Form(s)

W-2 here. Also

attach Forms

W-2G and 1099-R

if tax was withheld

1099-R is retirement income, pensions, IRA distributions. Perhaps that's the 1099s being referred to...the ones that show income and withholding.

But I don't think they are going to try to match up your 1099-MISC, 1099-INT, 1099-R with a bank statement. When you send the return you would show interest earned on Schedule B. A 1099-INT would prove you got that interest. The tax return includes Form 1099, Schedule A, B, D, etc. Anything you mail to the IRS whether it be a Form or a Schedule.

thanks for the input, nick-nick, but I was asking about the checklist or page 11 of the I-864 form (the page before the actual form), not the tax return form. The first item on I-864's checklist says all sponsors must submit tax return including w-2, and "each and every 1099s". all 1099 forms would reveal all the bank accounts and investment accounts I have, yet I don't want to include some of these accounts on the I-864 to avoid unnecessary complications. So can I do that? Or do I must list everything I have on the I-864 form?

If you are relying only on EARNED income then W-2's, that is all I did... I did not include any 1099 INT, DIV, OID, etc...

YMMV

:) well, as a poor grad student, my income is right at the edge of 125 poverty line, so I thought I should include some bank savings as well, but don't want to bother with too many accounts.

You must include ALL 1099's which are accounted for on the tax return.

But you don't have to fill out Part 7 unless you are using assets in place of, or in conjunction with, income.

Part 7. Use of assets to supplement income.
