You will be denied or you will get an RFE. There's nothing you can do at this point but wait and see.

If its just lack of evidence on meeting within the last 2 years she will get an RFE....NOT a denial

It depends. If she claimed somewhere in the filing that they were together during the past two years, I would expect an RFE. If she made no such claim and submitted only evidence of meeting more than two years ago, they may deny. I mentioned this already and the OP has not confirmed any such claim was made in the filing.

she stated their were also photos with dates on them of 2007.....i do not see a denial...but an RFE...they dont usually give denials for lack of meeting evidence but rather an RFE...thats why i thought saying she might get denied was a bit over the top. she also stated there was a letter sent of meetings and how they met.

Well, if I recall correctly in her letter .. or shall I say 6 page essay describing how we met ( i told her to keep it short, but she couldn't resist) she did mention , "Even while you are reading this letter I will be in new york to meet his parent's and see the big apple for the first time" so.. maybe there is hope?

I really don't know how severe the USCIS is about lack of evidence or if they give people another shot. :(

From what you have said about what evidence you sent, i see you getting an RFE possibly...it will delay your approval up to 60-90 days (thats just a timeframe they give you some get approved in days or weeks after an RFE completion)....but i wouldnt continue to flip out about it. :) everything is going to be ok. If lack of evidence is what you think will cause you a denial...i wouldnt worry at all.

To be honest I hired someone who promised me he had done the K1 Visa process many times with his other clients, and while I do in a way blame him for not adding all the information I submitted to him.

He told me the USCIS didnt usually fondle with much evidence as it's the actual I-129F 's information, your being able to be married freely, and your sponsorship financially that truly mattered.

Mmm...this would be a lawyer I would be firing, but that's just MHO.

(Didnt think the stamps is what would REALLY be useful)

Stamps in the passport, showing you and your intended were in the same place during the same time frame, are primary evidence....irrefutable proof that what you allege (the time point in which you saw your fiancee) is true. You should have included them. Your lawyer should have informed you better, but

I'll be sending off all the paperwork to Vermont and hoping someone there can read my letter and understand my situation.

I would not send off the paperwork to Vermont just yet...wait for USCIS to request said paperwork. You sending it without a request will just make what you send and your file to cross paths and you just defeat the purpose.

Nobody can give you a 100% answer as to whether your petition will be rejected outright or if you will be issued an RFE, or approved or denied. We can just advise you how to navigate this 'minefield' based upon our experiences. You have to take a chill pill and slow down the 'what if' thinking. This process will be a hell of a lot easier if you do.

Ah.. Alright, only reason I was considering sending is because the customer service at the USCIS said I should, and that it couldn't "hurt' my petition..

Guess your right. Being nervous over this -will- drive people insane ><; Just beating myself up thinking I should have done this when the time was right.

we like to call it customer diservice at USCIS....they tend to give answers demonstrating a strong ingorance of the difference between their a$$ and their elbow. :whistle:

Sending the info isn't going to hurt your petition, but it might not get to your petition. Not having met within the last 2 years is grounds for denial of the I-129f, but you made reference to meeting after the 06 evidence, so they hopefully will give you an RFE. Whoever told you what to send and not to send clearly has no idea what they are doing. Get your money back if you paid anything. Anyone knowledgable with the process would know to send in the most recent evidence of meeting to get the 2 year requirement in, not the furthest away evidence.

at this point, you just have to wait it out. I agree with those saying it will probably be an RFE, but regardless, you just have to chill, take care of yourself, be there for your fiance, and wait.

to start passing time, you should fill out your timeline! when did you file?

Yeah. :( The money dosent concern me half as much as the denial.. I just hope they give me another shot.. Like.. I dunno if they would Auto-deny or give me a shot ><

You are likely to get an RFE. You have mentioned other visits and they will want further information.

Everyone here is very knowledgeable and have provided you with all the guidance they can at this point. They have gleaned their knowledge from months of dealing with their own cases and helping others by answering questions here on VJ.

You are not the 1st to have omitted information.....and you wont be the last. So quit being so hard on yourself!!!! I hope you hear from USCIS soon.

Thanks all. Really appreciate the support and hope your all right about this.

I've never been the type to really stay solid, especially under pressure. This whole.. dont crack while being pressed on thing is pretty hard after all :D

To be honest, Ever since my fiancee left almost 6 days ago, I havent had a proper night sleep (without tossing and turning for atleast an hour) or ate regularly either. >> Guess im not good under pressure at all.

Either way, Im finally gonna try to calm down. Thanks again and goodluck to all who are still waiting for an answer.

i think if u wanted to try to match up ur noa1 with evidence u want to send i would make sure is copies i have heard of a lot of people (including me) trying to add something to their already sent documents and it just never seems to meet up.

if it does not meet up then when they send u the rfe u can send them more copies of it.

I agree. Wait for the RFE! You will get one for sure. Also, you will need to send a copy of "All" pages of your passport, or an official copy of your birth certificate, as noted in the instructions. I'm sorry you're having such trouble, but don't worry, the RFE should only delay you by 1 or 2 weeks. I attempted to send a cancellation letter for my last K1 with a copy of my NOA1. Vermont never made the connection, so I had to file a waiver this time. Good luck! :)
