Hello all, I would just like to introduce myself to VJ, I have been reading through the forums of VJ for about 5 months now, just before we petitioned our I-129F Fiancee visa.

Just wanted to ask a quick opinion question, In the midst of all the nerves I believe I may have made a mistake on my I-129F, and when I say mistake I don't mean information-wise.

Here's a quick description, My fiancee and I have been together for just over 3 years. The first time I went to (UK) To visit her, Back in April of 06', we had a blast. Since then she and I have made many trips back and forth including one just recently, for 3 months. (She left 6 days ago :crying: but that's a different story) My question is as follows:

When I sent my I-129F, I believe by mistake I sent "evidence" of us when we met back in April of 06, Like hotel receipts and pictures and ticket's for the airline etc etc.

Thing is, I just realized this (4 months into our process), Do you guys think that this is Automatic grounds of refuse or denial for my petition, or do you think they will ask me for a RFE (Request further Evidence) before anything.

I called USCIS's Customer service and they told me that an option I have is to send a letter filled with all my evidence, passport stamps, ticket's, and a letter explaining exactly what im sending them for, with my NOA1 number so they can track it.

Think I can make it right? Or is this a non fixable situation (In your opinions)

As I said, I've been reading through thousands of forums and whatnot for reasons of I-129F denials, and it seems I cant find anything under why they would deny me flat out unless for a serious reason like, if im not free to marry for example.

one of the requirement is USCIS needs proof that you both met within 2 years time, so I think the evidence you send (Ticket Stub, Visa stamps..) are invalid and most likely you will get an RFE, If you have your NOA 1 already, you can attempt to send them the evidence before they issue and RFE...

Yeah I understand, I remember sending them a couple of photos of us when she was in new york in 07, but the actual hotel receipts and plane ticket's I sent were from 06.

Im just worried that they wont give me a shot to prove our case before they shoot us down I guess. Anxious, nervous.. and sad at the same time.

Do they "usually" turn people down right away for evidence or do they give them a RFE, despite the delays I would much rather have a chance at sending them all the information I have literally right infront of me (The post office is closed here in NY.) rather then having to start the entire process all over.. Dont think I could deal with that kind of a nightmare. :crying:

USCIS rarely deny people straight out, they will give you a chance...

If the only evidence you sent is more than two years old a you stated that you've travelled there many times, they might send you an RFE instead of a denial.

What else did you send? For instance if you sent a copy of every page of your passport as proof of US Citizenship, there's plenty of evidence in there.

Facts are cheap...knowing how to use them is precious...

To be honest I hired someone who promised me he had done the K1 Visa process many times with his other clients, and while I do in a way blame him for not adding all the information I submitted to him. It's my fault as well.

I sent off 2-3 Pictures of us meeting, having dinner together etc etc. Dated them on the back. Photocopy's of the front of my passport. (Didnt think the stamps is what would REALLY be useful) a Hotel Receipt of the time I spent in the UK, naturally they all lined up with the 6 page essay my fiancee gave explaining how we met. (and I mean 6 page essay without sarcasm) and thats about it, He told me the USCIS didnt usually fondle with much evidence as it's the actual I-129F 's information, your being able to be married freely, and your sponsorship financially that truly mattered.

Looking back on it I wish I had made a book's worth of evidence to show we met and how many times, but at the time I was fooled by all his smooth talking. :huh: once again, my fault.

So .. You think they will give me another shot? I am more than positive the actual I-129F has no mistakes but this evidence bit is really making me nervous, and im not the type of guy to really shy away from the truth. I've cried a whole bunch since I just realized this.

Thanks' a bunch, All the honesty is appreciated and.. I hope for the best. I'll be sending off all the paperwork to Vermont and hoping someone there can read my letter and understand my situation. :crying:

I mean.. it cant hurt my case.. right? :(

If you have more information or evidence handy, then why not hang on to it and have it prepared in anticipation of an RFE? I wouldn't send it off without the request.

i think if u wanted to try to match up ur noa1 with evidence u want to send i would make sure is copies i have heard of a lot of people (including me) trying to add something to their already sent documents and it just never seems to meet up.

if it does not meet up then when they send u the rfe u can send them more copies of it.

Yeah, I guess i'll just make a ton of copies but I don't want my request to update my I-129F to mess up my petition either. Im at a crossroads' it seems.

Do you guys think I will get denied though? Or do all of you agree that more than likely I will have to deal with an RFE. (Again, I dont mind an extra bit of waiting time.. but the press the [reset] button on our petition would be horrid. )

Just also wanted to add a congrats to all september petitioners, October's next. Woowoo. ^^;`

Sorry if it seems like im spamming, Really don't mean too. I keep reading at a bunch of site's that reasons for a denied I-129F aren't usually because of evidence of support, Just curious if anyone else had an issue like I do??

Also, any thought's on the outcome of my problem, think they will give me an RFE or flat out deny me? :(

If you continue to drive yourself crazy over this and a denial...you will go insane.

If its everything they needed, you will get an NOA2...if its not...you will get an RFE...all you can do is wait. and youve already been advised that you will get an RFE before a denial for lack of proof or paperwork....your worrying yourself over a denial for something you still have a long time to wait for.

Also...it would be helpful for you to fill in your timeline.

You will be denied or you will get an RFE. There's nothing you can do at this point but wait and see.

You will be denied or you will get an RFE. There's nothing you can do at this point but wait and see.

If its just lack of evidence on meeting within the last 2 years she will get an RFE....NOT a denial
