HI, I Filed WAVA last year. Divorce is pending. I received RFE today. Can anyone help me what should I submit ? I already submitted marriage certificate, children birth certificates, lease paper, affidavits etc and after that I received Prima facie eligiblity.

DO I have to file the same papers again?

Hi Everyone,

I just wanted to ask about your experiences...

This is directed to the ladies who filed I-360 while married to a USC not LPR

I know we all filed Initial I-485 and I-130 based on our marriages..

Then when we filed I-360 we filed a SECOND I-485 based on the VAWA...

So what happens now? Do they deny your first I-485 and put you in proceedings? Or do they combine the 2 applications? What exactly is the process?

Any Ideas?

Hey Yayha, the RFE was sent to me in Febuary and I responded and mailed it back to them in April. The RFE they wanted was more evidence of marriage in good faith. However, my husband and I didn't have a lot of assests becaz he was in and out of job every since I met him. We lived at a family friend house so we didn't have a lease. I explained in details to USCIS by writing a letter with the help of my lawyer. I just hope all goes well and I hear something soon becaz the 60 days has passed so I'm wondering what's going on. Take care guys and continue to pray for each other.

Hey members,

I went to my interview yesterday and turned to be a real bad experience. Its not what i had in mind and its not what other people went through. My lawyer didnt show up and the office called me to tell me that he had an emmergency. I know he has diabetes but i was not sure what the emergency was. The interviewer came and got me asked me where my lawyer was i told him what they said. As we walked on the hallwy to his office he started asking me why am here for? i said for my VAWA interview. Then he told me to explian the whole VAWA story.

The spanish looking interviewer was very annoying and real bad that i felt like he was violating my human rights. he asked me all kinds of questions for about 45mins and kept going through my file for another 15mins. Some of the questions that i remember are: How did u come to US? why didnt u go back after ur F1 visa expired? did u marry for imm. purposes? was ur husband BLACK or WHITE? why did u go for deportation? did u divorce ur husband? are u sure he really abused u? explain the kind of abuse he did to u? did he cause any physcial damage to u? show me where? who told u about 1-360? i said the shelter case worker, he asked so thats what the shelter people are telling illegals to file i-360? where did u get the money to pay a lawyer? are u having an affair with anyone now? are u planning to get married? who do u live with now? what do you they do? how did u meet them? are they from ur country? what their immigration status in US? where do they work? whats there phone # and will call them to confirm this.

This man literally tore me part!!! He stamped lots of paper work inside my file. Then he asked for my passport, took my i-94, looked at my passport picture and asked if that was me, that i look different now!!! Then he asked me the 'NO'questions. Then he said he has to go through my file to see if will approve it or not, he also said i will call u if i need anything. i asked him if he had my #, he checked and confirmed it.

By the time i left there i had all bad memories about my abuse and he made me hate my self. I felt like i really needed to see my counsellor or my psychriast immediadety before i do harm to my self. Am writing this to see if i can feel better or somebody can comfort me in this forum. what do you think guys? do u think am gonna be able to put this mess behind me? do u think he did this because i had a deportation order. Hi, Kwala u had said am crazy, but now am really depressed feeling so low that i can destroy my soul. ooohhh plz somebody tell me something.

sorry about what hapened to you at the interview stage .DONT WORRY .if the officer took your i-94 that mean you are approved .

why he is go trough all this question ,beause your attorney not show up that why and he take so long .

but al those question are easy .!! .

you just need to respond ,you have no things to hide from the officer .right .

i wish i have that questions .

I'm sorry to hear about your awful experience mgeni... I has a second AOS interview that I went to without my husband, and the IO tore me apart too... It was terrible.. so I feel your pain :(

Also my I-485 was Transferred to USCIS Office on 07/01/2010 .......but I don't know if it is a USCIS Local Office 

My I-485 was also touched today on 07/02/2010

I pray for a quick and complete approval of my I-485.....OMG! I can't wait anymore, am so happy and nervous at the same time. Please guys can someone tell me what is the next process from here.. My passport has expired and I need to renew it ASAP...I might be called for an interview soon. Yahyah hang in there approval is on the way.

I am so very sorry to read this.

He will have to give u an approval anyway, but he really was not supposed to ask all that.

45 minutes interview? Wow! He was just mad at his life. Dont worry about him. USCIS already approved everything right.

Thank u guys for ur comfort. I didnt have anything to hide because most of the questions he wanted me to explain all information was in my file. like he wanted me to show him my scars from the abuse but he was looking at the pictures i had sent with my i360 package. He wanted to know what the judge said but he had all the court proceeding paperwork in the file. He wanted to know why my husband was married to other women but the information is open for public. Am still crying and cant help it. I really dont know what to do next.

Kwala & mulanjohns how sure are u that he will have to approve it? I have lost the little faith i had in my soul that what i see now is denial.

Kwala u think the questions were easy? he made me cry when i was explaining some info. I really did not want to remember that, but he kept going on & on.

On this situation .i think is an approval because Officer took your i-94 .in the case Of denial he should not take the i-94 i think .but if he is unable to approve your i-485 .the uscis vsc will send you REQUEST OF EVIDENCE

Mgeni just continue to pray and have faith in God!!!! I'm still waiting for my case to be approved!!!! I thought I would hear something this week but my case was touched last Saturday and that's it!!! I can't wait for this to be over!!!! Its annoying and stressing. I have nightmares. Kwala, why do u think they are taking so long????? 60 days has passed!!!!
