Getting Married in US and then coming back to Canada

Hi,

I am a Permanent resident in Canada and would like to get married to a US citizen. My fiance lives in New york. I have a tourist visa. Should I enter US on a tourist visa and get married and then return back to Canada. I work in Montreal and have no intention of staying in US. I would go on a weekend , get married and return back on Monday.

Once I return back to Canada, we do our consular processing.

Please advice if I should go on a tourist visa to the US and get married and come back and process my consular processing.

Should we get married in Canada instead ?

Can't answer whether or not you should get married here (in the US) or in Canada - but you certainly can get married here (in the US) - people do it all the time. :thumbs:

That is a perfectly viable option. I would advise you to use the same kind of generic but truthful answer when asked for the purpose of your visit. No need to mention that you're getting married and subject yourself to extra scrutiny. Bringing some evidence you have strong ties to Canada and will return would be a good idea just in case.

Yes, the subject comes up so often that there have been three new threads started today where people want to marry in the US and leave. Hopefully the nonsense in yesterday's thread won't spill over to all three of these new ones.

Yes, the subject comes up so often that there have been three new threads started today where people want to marry in the US and leave. Hopefully the nonsense in yesterday's thread won't spill over to all three of these new ones.

I understand the legal requirements. We can get married in Canada. the only drawback is that it take 3 months to registor the marriage and get the certificate. In US it take 2 weeks to ge the marriage certificate.

My only concern is , that I will be going to New York for only 3 or 4 days on a tourist visa. I would get married and return back to Canada. We would file our consular processing from Canada.

Will this cause problems in our application..

No but you confuse me when you say you would file your Consular processing from Canada. If the US Citizen is a resident of Canada and you file directly with the Consulate in Montreal, no problem. Also, if the USC resides in the US, there's not problem filing the petition in the US.

I am in the same boat as you are. I just found out that it takes 8 weeks to get the marriage certificate in Toronto but only 2 weeks in NY where my fiance lives. I also have a visitor visa to US and thought it will be a better option to get married in US. But I am worried about the interview. What if the interviewer asks me if I disclosed my real intention for entering US and was it planned that I will enter on Tourist visa, get married and then come back to Canada. Will it cause any issues?

As long as you give a truthful generic answer, there will be no problem. At your own discretion, you may simply indicate your plan to marry and return to Canada. If that's your choice, be prepared to show evidence of your ties to Canada and of your clear plans and need to return. Also be prepared that they may not believe you and turn you away. If you're carrying a wedding dress in a hanging bag, while speaking with the CBP agent, I'd be pretty straight forward though.

No special visa is required for entering the US to marry as long as you don't intend to also immigrate during the same visit.
