I recently had major neck surgery, and I have been on FMLA/STD (Short Term Disability) since November. I tried to go back to work before I was ready, and worked two days. My job considered it a relapse and suspended my pay until my benefits were approved again. Long story short, I didn't get paid, nor did I get any notice of not getting paid. I was devastated because this has caused me a huge financial burden now.

VSC just submitted the check on the 29th, of course it will be returned. I have a case # and the system states that they have mailed my NOA1. My question is this, will they try to draw the funds again, or will they just return the petition and give me another case number? I will be getting paid because my FMLA/STD benefits were approved. I know that I have seen something like this posted before, but I don't remember what transpired. Any info you can provide will be helpful. Thanks.

It is very likely they will not run the check again - result will likely be a rejected petition.

Try contacting your financial institution for help - they may be able/willing to do something.

Their stated policy is to scan and convert checks to electronic transactions and submit them twice if needed. Of course, they don't always follow this policy. If they don't reject your petition, they'll employ means of collecting on the check.
