I have received my Green Card under the family based category. Since my marriage to my spouse (the US Citizen) has not completed 2 years, I have been granted a conditional green card the expiration date of which is 2 years from the date of issue (dated 12/11/08). I will have to request to remove the conditions shortly before the expiration of my green card which will be 12/11/2010.

I will like to confirm that I am treated at par for the purposes of employment and my conditional green card status status doesn't in any way stop me from taking an employment based on my GC.

I had an H1B which expires in April 2010 and I have recieved a job offer from a Company and I will like to use my GC status and not go for a change in H1B or apply a new H1B, so its important for me to ensure that the conditional GC doesn't in any way pose any problem if I leave my current job (where I still have a valid H1B) and accept the new job (based on my recently recieved GC).

I look forward to the advise in helping me fix this small clarification so that I can make a well informed decision about my job change.

As it relates to benefits associated, a green card is a green card. Period. 2 years or 10 years ... all the same... As a green card holder your pre-existing H1B is no longer valid. You cannot get or change an H1B because you are no longer on that status...

In short, there is nothing in the way of your being able to take any job that is offered to you. In that respect, you now have the same legal status as a citizen so long as you obtain the ten-year green card in 2010. Visas are no longer needed for any reason.

The conditional card has full work authorization. The only potential complication I see would be that the employer might be leary of hiring you if they want assurances you can stay long term. You can, of course if you do the proper paperwork at the right time AND have not entered into the marriage fraudulently. It would be a strange concern for an employer but a potential one nonetheless.

Facts are cheap...knowing how to use them is precious...
