K! Stupidity - Advice?

Timeline

Hi All,

My fiancee and I submitted a K1 back in october but we were so excited etc we filled out the forms only. We didn't realise (stupid I know) that there was other evidence that needed to be included - photo's, birth certs, statements etc.

Will we receive an RFE or will we be rejected outright?

As long as you have the required documentation ready when the RFE comes, your error will probably only cost you a few weeks.

Well, maybe. If they determine it is a signifigant numbr of items, they CAN reject, but since they have your money (have they cashed the check yet?) they may send an RFE, and as stated they will pick up where they left off. I only say this because they rejected my wifes EAD because I filed it on an "outdated form". I had to re-file on the new form, BUT the EAD was filed with her AOS and was basically "free", there was no extra fee associated with it, so that may make a difference, the truly hate to send your money back. :) Bless their government souls

Well they cashed the check and we've been "case received and pending" since mid october. I'm just hoping they don't reject us outright when they get to it. We did send the missing info in late december when we realised in the slim hope that it would be matched up but that was just clutching at straws really.

And I thought they'd just keep your money if rejected?

prepare your evidence docs as early as now so when you get the RFE, your can mail back USCIS immediately and lessen the wait time.

You will received RFE and send it back overnight, the sooner you get it send back the sooner they will process it, I hope.... I see K! approved as little as 3 months. Anytime you have question just ask anyone here, we have the same information one work or the others.... Goodluck...ASK before sending and follow instruction every steps. If the answer is blank, write down N/A for question that is none.

So what your waiting for, get you stuff together... and you can actually starts getting the other documents you needed while waiting.

I spoke with USCIS last month about my petition because a week after I submitted my packet I decided to come down to Nicaragua to be with my SO. The man on the phone told me that I could send in any additional information about our relationship whenever I wanted. Just send a photocopy of your NOA1 and a cover letter with your information. I am having a friend take back the evidence this week to mail it in when she gets to the states. I would just send in the stuff now and not wait for the RFE...but who knows. Do what you feel is right. Good Luck!
