Will you be denied if you are unemployed and having trouble finding a job?

Timeline

Will your case automatically be denied if you, (us citizen) are unemployed? What if you just can't seem to find a job? The economy is really crappy! What can you do? I have a friend petitioning for her husband as well and she is having trouble finding employment. my friend's mother is sponsoring her husband for the aos application because they are having hard economic times. Are immigration benefits made only for the perfect, middle-class and rich people who can pay up?

Timeline

I've seen one long time member here say once "no money, no honey" ... which is unfortunately a cold but real response. I've had this feeling myself many times and I struggle to figure out a way to get my family home when the paperwork is approved. I'm still looking at all the costs after the NOA2 plus my flight over for the interview plus flying my wife and step-daughter home, to getting a bigger apartment to live in to ... well, you know the story. I work a full time job that puts me over the 125% threshold, but there's no way right now I can save a cent to bring my love home. I'm desperate to find night and weekend work just to try and make everything work.

It's really not fair that because you found love with someone outside the U.S.A., that in the end, money, or the lack of it thereof, can keep a man and his wife (and his children) apart.

But then, life is certainly not fair :angry:

Oct 30, 2008 - NOA1 for I-129F mailed to me - received 11/22/08 because of address change

Oct 31, 2008 - I-130 Touched

Nov 3, 2008 - I-130 Touched

Nov 18, 2008 - I-129F Touched

Nov 20, 2008 - I-130 (for step daughter) Touched

Feb 17, 2009 - Case received by the NVC

Feb 25, 2009 - Received letter from NVC dated Feb 20th saying they had received my approved I-129F

Feb 27, 2009 - Received 2 letters from NVC dated Feb 20th - they had received both approved I-130's

Mar 6, 2009 - Medical for Ksenia & Sasha completed in Kiev. Everything is great.

Mar 9, 2009 - Called NVC and found out our K3 is in "administrative processing"

Apr 6, 2009 - OUT OF A.P. !!! File being sent to Kiev !

May 5, 2009 - K3 interview in Kiev! APPROVED !!!

July 12, 2009 - ARRIVAL IN USA !!!

not at all, immigration benefits are given to those who earn 125% above the poverty line and are bring a new person into the country who the government does not feel like supporting immediately.

so not quite the rich and middle class, just a small percentage above minimum wage - which is perfectly fair because for at least a certain amount of time, you have to support two people on that wage

09/04/2008 - Checks deposited

09/10/2008 - Checks cleared ($1010 + $355)

09/12/2008 - 2 NOA's received (I-130, I-485) - Dated 09/08/08

09/16/2008 - Received notice for biometrics appointment on 09/30/2008

09/20/2008 - Biometrics done - Walk in (Orlando) Took 10 minutes

09/22/2008 - I-485 viewable online (pending, of course)

09/30/2008 - Biometrics Appointment (2pm)

12/30/2008 - Received Interview Letter

02/25/2008 - Interview

03/06/2008 - Welcome Letter received (the website will clearly never send me updates!)

Well I am confused now... I just posted a thread earlier this morning asking pretty much the same thing. My SO cannot file an I-864 because he doesn't have an income that is taxed. Well it is taxed but in his sisters name so he gets no W2's or paystubs. His parents are willing to do an Affidavit of Support for me we are living with them and the person who responded to me said it would be fine and it would not jeopardise our case. I am not questioning whether anyone is right or wrong but is there someone who can clarify?

11/18/08 - Arrived in U.S. on B2 visa

02/05/09 - Extended return plane ticket to stay for an extra 3 months

04/23/09 - Decided we didn't want to be apart even though we extended the stay and got married!

04/30/09 - Sent I-130/I-485/I-765 from B2 (no I-693 as it is not yet complete.)

05/03/09 - Received email form USPS stating that package had arrived safely and was signed for!

05/11/09 - Received NOA1's for I-130/I-485/I-765

05/16/09 - Received Biometrics Appointment

05/30/09 - Received a CRAZY amount of RFE's that were dated 05/21/09

06/01/09 - Biometrics Appointment Scheduled. In and out in 10 minutes!! Sent off RFE information (Should arrive in MO on Wed.)

06/03/09 - USCIS received RFE response

07/23/09 - I called to have a service request put in

07/24/09 - I-765 Touched (FINALLY)

07/25/09 - I-765 CARD PRODUCTION ORDERED!!!!!!!! (About time!)

08/03/09 - EAD card came in the mail WOOHOO!!!

08/07/09 - Interview letter arrived

09/02/09 - Interview Date

09/07/09 - I think this is the day I received my Green Card.. Can't quite remember anymore.

Removal Of Conditions

08/03/11 - WOW it's already been TWO years! Sent ROC package to VSC.

08/05/11 - NOA1 date which arrived 8/10/2011

09/02/11 - Bio Appointment the notice was dated 8/12/11

if your US cit spouse/fiance does not have an income, they are below the poverty line, and will need a co-sponsor

Aloe, reasking the question in multiple posts will not change the answer. Your spouse must still file an I-864 AND you must use a co-sponsor.
