I met my girlfriend online April 2008 and we have been together since. She currently lives in the Philippines and the first time I met her was in October 2008. Our daily communication would be the use of skype and also just falling asleep with our headphones on. I know it's cheesy but I love it, makes me feel good knowing shes just on the other line. So I met her on October, spent time with her family and was there for about a month. She comes here in the U.S. for 3 weeks in December and I end up proposing to her in Las Vegas up on the Eiffel Tower. She currently has a B1 Visa for 10 years and she's back in the Philippines. I do plan on seeing her this February 2009 for 2 weeks and also in July. She will be coming back to the states in July.

What I'm asking is what would be better? Would it be beneficial to start the K1 Visa or marry her a 2-3 months while she's here in the states. I know the K1 may be longer but it is also safe while deciding on marrying after 2-3 months while shes here. (Hopefully customs give her that) We spoke to people around us and some people say to just get married here in the States and don't do the K1 while others, like my mom and dad encourages me to do the K1. What should we do?!

If we do the K1 process I do have the 1-129F, what should I include with that also? Can you guys give me some info on what other forms you sent with your 1-129F? Thanks ^^

The best thing for you to do is read the guides...it will help you step by step.

as far as telling you which route to take, that is completely up to you.

well according to USCIS site, it looks like both K1 and K3 are taking about 6 months for approval. So its up to you 2 to decide :)

but i do urge you to read the guides...you can also read on both visas, that may help you decide as well.

either way you can visit her in her country or you in hers during the process

As much we enjoy going to the Philippines and the U.S. it's getting difficult in trying to save money, especially our economic status that we are in right now. So we have either the decision of the K1 or I would decide on marrying her 2-3 months after she gets here in the states. She doesn't know about it and believes that we are having a traditional marriage in the Philippines on February 2010. So I would like to have the spur the moment feeling especially hoping and praying they will give her at the max 6 months stay in the U.S.

You have proposed to her and now both have intent to marry, if she comes into the US now and marries you and stays she is likely to be deported for fraud (a B2 is a tourist visa not a marriage/fiance visa).

You can return to the phillapines and marry her and complete the K3 application, as the AOS is done during the process so she comes to the US with a green card the process seems to take about 9 - 18 months to get, and she will have to wait in her own country.

The K1 takes about 6-9 months from filing, but when she gets to the states she can't work till after you complete AOS after the wedding.

Both the K1 and the K3 mean you will have to under go this crappy wait appart, she can try to visit you during the process in the states but there is a chance she will be denied entry as she will have intent to stay. There is no short cut, no loop hole that makes this any easier especially when dealing with a high fraud country, if there was, this site wouldnt be here because we wouldnt be all hating USCIS....

07-17-2009 Court day 2: Success, must respond by 21st August. - No result ever came from this.

10/24/2009 CR1 packet completed and posted

10/26/2009 Packet arrived at Chicago - And Submitted our Aussie application

11/04/2009 Application of CR1 returned - was rejected because of a "blurry zip code" we didn't bother to re-apply given that Chris had lost his job

04/05/2010 Australian application still pending

September 2010 - Chris arrived in Australia on Temporary Visa.

10/10/2011 - 2 year wedding anniversary - Chris to be granted Australian Permanent Residency

Summer 2012 - Planned immigration to USA.

Well I have started the process for the K1 visa I just hope it takes 6 months for everything to be cleared and good to go. I have a question in regards to the G-325 Biographic information though, on the Family name, the 3rd column down it says Father Mother (Maiden Name) is that supposed to be her fathers mother's maiden name? It also asks if this form is submitted in connection with an application for A- Naturalization, B- Status as Permanent Res C- Other (SPECIFY). Which one should I chose in that field. Thanks! =)

Mother's maiden name.

0ther: I-129-F or K-1 .

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Whoa there! The K3 process doesn't have the AOS process occur while the foreign spouse waits abroad and the K3 holder doesn't enter with a green card.

CR1 enters with a green card. K3 adjusts status in the US after arrival. The product of a successful AOS process is the green card signifying Legal Permanent Resident Status.

Please study the different visa options as this description has confused them considerably.
