I-130 Mistake

Hi,

I made a minor error with form I-130. I forgot to submit the correct amount for the fee. USCIS sent a rejection notice saying to submit the correct fee.

No problem.

Do I need to send anything else, like write a letter, so they will know why I resubmitting?

Do I need to redo the I-130? Or, should I just remove the staple and resubmit?

Do I include the rejection letter?

I would re-send the entire package you had sent them earlier with a copy of the rejection letter and a check with the correct fee. You can also sent a cover letter, but that's completely optional.

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Thanks for the responses.

Clarification: I didn't realize that I had to submit a separate fee for the child. USCIS didn't return the other documents, the other I-130 for my wife, two-G-325A, marriage certificates, affidavits, birth certificates, the other check.

That was proper considering that they did receive a fee payment, but only for one petition.....

I would definitely put a new cover letter stating that it was returned, for what reason, and how you've corrected it. Probably re-sending all the paperwork wouldn't hurt at all either. At least you know they have EVERYTHING right? Good luck!

Thanks. I resubmitted everything, all the paperwork, certificates, photos, affidavits, check, rejection letter, letter of receipt and a cover letter explaining the reason for the resubmission, today. Good luck to you too. I see you've been at it since April 08.
