I got my RFE recently, however, because we instructed a lawyer to act they received one too.. so i got the paperwork they requested, do you think its a good idea to send the paperwork to the lawyer and have them forward the paperwork to the gov.. or should i get a copy of the RFE and send the paperwork myself. The lawyer says she needs to prepare stuff??

ideas?

How come with a lawyer you can get a RFE, it makes me crazy ! You should kick his/her a$$ !

If you received the RFE by mail, with the RFE envelop, you should send your documents by yourself.

If your lawyer has the original RFE letter, you should send him/her your document.

it can take from 30-60 days

there is no minimum of 14 days

Hey Sinergy

When you say it can take 30-60 days... it seems as though many people on this site get approved within days of the USCIS receiving the RFE info. Any insight as to why that is the case?

It depends on your adjudicator and your case and what you had to send in. Not everyone will get NOA2 days within sending it.

I am a little bit of nervous because the information that I sent with the petition it was the same one. The only thing that I did it was to organize the information and translate this time all the stuff that I sent. It is possible that they send me another RFE????? One more question I took a trip to see my fiance but after I have summited the petition. Does this trip count in meeting as well in person within two years? I am asking this because this trip is the only one I was able to save boarding passes. The other ones I did not save and I only bought them with my visa. But apperently it was not enough proof to meeting in person. I also sent pictures but they did not consider those pictures. I resent those pictures again. Do you think it was a good idea???

I appreciate all these response....

Thanks

Yes, you should send the boarding pass you have because it is a good proof that you guys met in person during the last 2 years. Try to find all the documents that you can, maybe your bank documents showing that you used your visa in the US during your trips. I got a RFE on dec 11, if I have a good advice, send your RFE documents with FEDEX. It took 10 days for my documents to arrive at the Laguna Niguel immigration which is 100 miles away from my house

With Fedex your folder will arrive in 2 days...

Thank you very much for your input :-)

I based the minimum on the form letter USCIS sends out with the RFE (sometimes) :

"From the date this office receives your resubmission, a minimum of 14 days will be required to process your form. If you have not heard from us within 60 days, you may contact the USCIS...."

It's not a hard/fast rule, they probably stick that in to give themselves a time out period!

Not everyone gets this message though. Your mileage may vary

and seeing the OP was approved - they worked pretty fast on it

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

WARNING: Phrases in this post may sound meaner than they were intended to be. Read the Adjudicator's Field Manual from USCIS

OP i believe i read correctly that you have seen your fiance before filing for the K1...if so you have NOTHING showing you met in person before filing??? nothing at all?

if not, its ok, just send what you have now, send everything they asked for and you will be ok.

good luck

If you provide what they need, it shouldn't take that long. Mine only took 4 days

Hi Everyone!

I was wondering if anyone knows how long does it take to get the NO2 after I send the RFE all the information. I sent all the RFE in 12/23/2008??? What is the next step to do??? suggestions please. Thank you very much for your input....
