Has anyone ever been late filing the papers???

Timeline

Mo's visa runs out on 020408. Intentions were to have his papers filed by that date obviously...then murphy and his law moved in...car wreck=car payment where before there was none, moved into a "better" house and deposits for everything ended up being about 500 more than expected...####### just life in general. Taxes will most likely not be back in time to make that deadline. I did get a 2nd job today part time 3rd shift so maybe that will get us half way there and inshallah taxes will make it here before, but if it doesnt what happens? What happens if its the 14th not the 4th??? Anyone ever encounter this problem before? Im freaking out here!

We filed for my husband's AOS a few weeks after the I-94 expired (the K-1 visa expired as soon as he entered the country on it). Because someone in another forum did run into problems by not filing for AOS timely (I think they waited more than a year, and the immigrant spouse was traveling alone several states away and got picked up by ICE) I won't say it can't possibly cause any problems. But I will say that I know of several people who filed after the I-94 expired. In some cases, they married very close to the 90-day mark and had to wait to receive their marriage certificate.

I'm the USC.

11/05/2007........Conditional permanent residency effective date.

01/10/2008........Two-year green card in hand.

08/08/2009........Our son was born <3

08/08/2009........Filed for removal of conditions.

12/16/2009........ROC was approved.

11/05/2010........Eligible for Naturalization.

03/01/2011........Separated.

11/05/2012........Eligible for Naturalization.

Timeline

There are a number of people who have filed for their green card after the 90 day period. The important part was to be married within the 90 days designated by the I-94. You don't have to file for AOS within that deadline although it keeps your status valid if you do. A few days/weeks out of status while you prepare the AOS is not going to cause you problems with the AOS. File as soon as you can; you should be fine.

we filed for AOS about 3 months late and had no problems with it, HOWEVER it certainly delayed the timeline for my husband to be able to work and by the end of it he was stir crazy and EXTREMELY CRABBY to put it gently. But you can only do what you can do... :)

Thanks everyone...Mo was calm with it...me I was freaking. Now I can calm down maybe, yeah he is wanting to work badly but there are alot of home improvement things he can do here to keep busy...he got power tools for Christmas..everyone pray lol.

Seems like everything has happened since he came here and Christmas spending didnt help....
