My wife came over on a K-1, we got her SS# then got married (about 60 days after she arrived). We are filing the AOS about 20 days late (after the I-94 expired) SSA will not allow us to change her name to her married name until she gets her permanent residence. (because the I-94 is expired)

Now we have her on my insurance under her married name. I guess we need to change that and also do our taxes under the name on her SS card. right?

Do we use the name on her SS card for the AOS? The EAD might not match her SS # if we use her married name.

Do we get her passport amended to her married name now? The consulate told us since she is still a Philippine citizen her name change would be: first name, MAIDEN name, new MARRIED LAST NAME.

Thanks, Keith

Use the name on the AOS/EAD application that she wishes to be known as.... you can correct/change SS card when EAD/GC is issued.....

I would leave it in married name on insurance. File taxes in married name. The IRS will associate her the taxpayer with her married name and that SSN no matter what it says on the card.

Use her married name. You do want the EAD in the married name don't you? Just change the SS card later.

First maiden married names is a good way to do her name on things.

<first name> <father's family name> <married last name>

You will use this same format for submitting passport amendment/renewal and report of marriage.

It is important that the permanent resident card matches the name/amendment in the passport. The amendment and report of marriage (submitted through the Philippines consulate) will use this format. You can change the SS card to reflect this name once you have the EAD or permanent resident card.
