06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That is a very good point. That was also mentioned to me in speaking with the congressman. It does play a big part in sex slavery "in fact". Seems to be allot of these cases in the past with sex slavery. This whole Adam Walsh act could be part of there screening process. Because if you really see what this new law Say's, it Say's that all sex offenders are not eligible to file, unless the the adjudication officer feels you POSE NO THREAT. Then you have to go through the steps for Biometrics to have your information in the system in case for some reason you file again in the future for another petition for a spouse , fiancée etc.

Now the good question i will ask in my Interview Monday with my appointments scheduled in Portland will be is why are all these cases still pending if a person is a sex offender? Why are they not flat out giving a denial's to the petitions?

Well there again they were quick to adopt this law and maybe did not think about those who may file many law suits once Immigration replies with a denial. Ether because personal civil right are being violated or some other unconstitutional law being broken. I heard ACLU just picked this Adam Walsh law up. It's also losing from state to state battles due to unconditional laws. "Look at Nevada just recently it was held back".

Example like my case i did my probation, I'm not registered as predator sex offender. I have full court order custody of my children, It was a statutory situation. The Adam Walsh really was more intended for INTERNET predator's and to crack down on them. Now Immigration was quick to adopt this!!! It freak en has nothing to do with Internet, but to have another way to deny petitions and make sex offenders think they cannot bring there spouse here. This is my fight and the reason I have gotten as far as i have. Yes my past was a BIGGGG mistake, and i know I should have used better judgment in my decision. I'm not here to be in denial. But it was 12 years ago and I'm done with being punished for it. I will keep fighting until I get my wife home with me and my children.

Hello yes I just got a response back on Monday. I received a letter called INTENT TO DENY. They are giving me 87 days to prove i pose no risk to my wife. If I cannot prove this they will deny the petition.

So here we go i have to basically send enough strong evidence I will pose no threat to my wife, show them my history from the time of my conviction until now. I will have to do a behavior modification and some evaluations by a licensed therapist to make it more official and argumentative.

If you pray please keep me and my wife in your prayers because we will need it. The letter I received back was a blue slip and it just said I have until April 5, 2009 to send any supporting documents back to them to over turn there ruling and decision.

I'm not giving up i will fight all the way to the appeal process if necessary.

Dear Angia and Shane ..i ll pray for u and im close to you with my heart cause i understand your pain,i already sne du an email but may be was lost,anyway i aply for K1 in september 2007 and in December they told him to scheduelle an appointment but may be we write a letter too,i wish u so much luck and patiente to handle the pain in ur hearts of beeing away with the one u love.

At this point, a good lawyer would help advise on what would be sufficient evidence -- not necessarily an immigation specialist. To a shrink's report, I would add favorable letters from your friends, employer, your minister or priest. You have your work cut out for you, but a fair amount of time to get the job done.

Google the acronym NOID - Notice of Intent to Deny. (You might expand your search to "USCIS NOID" or "immigration NOID").

I don't wish to alarm you, but you are now in a precarious situation and DEFINITELY need to seek professional assistance. Find a good, qualified immigration attorney. Remember such an advocate needn't be in your city or state - immigration law is Federal law so any qualified and credentialed attorney in any State can represent you.

You will need to share with your attorney any and all documentation you have sent to the Service thus far. And you will need to follow his or her advice as to how to fight the NOID. What we as laypeople think might work may not be sufficient ammunition.

when i filed in july 08' i knew that it would be an uphill battle but i had no idea what would really happen. the I 129 F petition is clear about IMBRA yet there is nothing about the Adam Wash Act. since i have become aware of the AWA, this was only in the last few months, i have wondered why does the USCIS just not deny everyone involved? it seems to me that the as american citizens we have the legal right to use the USCIS and to file petitions for this and that. we paid out filing fees and now we want service. when the AWA was signed into law this provision stating " ... pose no threat to... " is an obvious loophole allowing the sex offender/petitioner the possibility of being accepted. so here we are, the USCIS has to be careful in how they will respond to this issue as whatever decision's they make will be the presidence that all will be judged by and they have to avoid any wrong doing by depriving the petitioner of the legal right to file and expect a favorable response. perhaps all of we petitioners should get together and collectively put our concerns into written form and submit it to all parties involved? congress persons, ombudsmans, senators, uscis, homeland security and president obama. we are involved in this system and we should do all we can to get clear directions and favorable answers to our issues. please share your comments and opinions with us all...

Hi,

Does anyone from here,who applied for K1 or K3,in 2007 who are affected by Adam Walsh Act,recieved any other news,like u "AngieYShane",did u present some of the proofs they ascked you?are arround 6 weeks since they answered you so this would be half of the time they told you,please write few words about how the process is working,share with the rest of us in the same problem your experience,thank you and hope everithing will have a happy end for you in this long journey.

About my case on 5 of February we send a letter to the Ombudsman,they send us other letter saying"they contact USCIS saying they should issue a response within 45 days regarding our case,in case this will not happened they ascked us to let them know again with a letter"

Are aloust 30 days since the nottifyed USCIS about our case,so in 2 weeks i hope we get something from USCIS or will have to send a letter and asck again help to the Ombudsman,in the letter we send we sayed that we applied one year and half ago,we also sayed everytime we called they tell us to wait 6 months for more Backround Checks.

I know everyone facing this Law has to stand the thought u dont know when u ll get an answer,and time already lost the value in our lifes,desperation is affecting us and sometiems is just better to forget what day is today or what day was yestrday,looking forward on the day tomorrow hoping someone there in that Immigration department will give us the answer we wait in such a long time.I hope everyone will keep the strenght and patiente till will find a way to be with the oens we love,keep the positive thoughts in your minds,keep your heart open for good news and pray everything will be good for all of us.

If someone here found out new informations please let all of us know,is so frustrating when i come on visa journey and i look to see some new posts of Adam Walsh Petitioners and i cant find anything ,i hope you are still in this journey and please dont let this situation to keep ur soul appart of the one you love,and dont give up.

Hello I will be giving a update shortly how are waver is going. In Bogota now as we speak with my wife going through some of our paperwork process. Once I return home I will give a very detailed event on how this process is going and what steps i have taken. Right now my wife is writing a letter she is aware of my past and feels I pose no risk to her. We are also getting letters from her mother and father about how they feel i have impacted in a positive way in there daughters life. My charector and how I have treated there daughter. We also met with the paster of the family church and got his recommendation on our marriage and how he feels about man and wife. All of these letters are very important and are being translated in english.

I will mail off all my documents alone with Polygraph results and other imformation. I have also spoken with immigration recently about the Adam Walsh and it was clearly stated that if my wife knows that is about the only thing that will help us. I will take all the information i gather and write my own waver.

Speak with the rest of everyone soon.

Hi,

For the ones who read about my case...me and my fiance wrote letters to the Ombusdman like hmm several letters 3 i think,after first they sayed to wait 45 days cause they contacted CSC to find out what is happening with our case,after this 45 days time when we send a letter to CSC and we got no answer,this 45 days passed so we wrote again to Ombusdman saying those 45 days passed and nothing is changed ...yesterday we got a response from Ombusdman saying this...they contacted CSC for us again and they gave us a number for our case and between 90 to 180 days since the nottify letter we will get a final answer...hmmmin 6 months will be 2 years since we filled,always they answer to wait but now they say will be a final answer ...so thas all i can say about "progresses" in my case....if someone in the same situation got something simmilar im looking forward to see if is any diffrence .....

my fiance' (USC) just received his biometric appointment also yesterday and his appointment is in 2 weeks time, after waiting for 1 year ...we're wondrin' what's next also..maybe weeks, months, years..guess we'll never know :(

Hi all again...

I am confuse. My fiance had a schedule for biometric but he sent back the notice and ask them to re schedule it. It was sent certified. The next day he received a note with a signature they receive it. I hope they would still process our papers and then give us another appointment.

I missed him so much and I felt like crying....
