Thanks AussieGal - that makes me feel much better, we are planning to do the same, send in the prior info plus some other stuff we have come up with and hope for the best. We can only assume that they have lost some of the info...

I really don't think everyone will have this problem, I think it is just our luck of the drawl so don't be worried others, it's just another step in the visa journey  I don't think the only reason this happened was because I haven't changed my name and we don't have children - I just don't like that it is their #1 wanted form of evidence, so please don't worry about your applications, it's just my personal opinon, I'm sure you will have pleanty of information to send in.

thanks all - cheers!

Merp & all:

I, too, dont think that no kids and no name change are the reason for RFE. USCIS cannot reject based on this as they just can't do that otherwise a law suit will follow them for invading people's personal life and taking their freedom away and its against basic US constitution. Period.

I posted earlier was just on lighter side since people were talking abt babies...but I wont worry abt it.

We are planning to apply this week for 751 and we are above 30s and have no kids and no name change either.

Merp - USCIS is notorious abt missing files/docs and overlooking things...so GL to you...

Ours was approved - we have no children together and I did not change my name. The RFE is probably as simple as somebody messed up the documents you submitted. OP: Good luck!

No need to apologize. Dealing with USCIS you never know what to expect. And I will have to deal with them again in 10 years because I am not going to apply for citizenship. Lucky me

I think we sent:

1. Joint bank account statements

2. Joint credit cards

3. Car insurance under both names

4. Driver License showing same address

5. Health Insurance from both my & his work showing spouse name included in coverage

6. IRA beneficiary statement

7. Phone bill for family plan - shared

8. Picture of trips taken together

9. Affidavit from my FIL and MIL

I may forgot some items submitted but I think that's all. No lease as he got on the lease before I got here and we were on month to month basis. I probably included wedding invitation from my friend addressed to us but that's all.

No kids, no name change. Oh....and the cover letter.

Merp:

You know what, as I was just checking 751 instruction, following is pasted from that...

And since they asked you more evidence abt "communal living" and if you can check point no 2 in below and if we coorelate with the query than you might also want to focus/stress on explaining or giving some evidence on joint occupancy/ownership of residence...

good luck...

****************************

Evidence of the Relationship

Submit copies of documents indicating that the marriage upon which you were granted conditional status was entered in ''good faith'' and was not for the purpose of circumventing immigration laws. Submit copies of as many documents as you wish to establish this fact and to demonstrate the circumstances of the relationship from the date of the marriage to the present date, and to demonstrate any circumstances surrounding the end of the relationship, if it has ended. The documents should cover, but not limited to,the following examples:

1. Birth certificate(s) of child(ren) born to the marriage.

2. Lease or mortgage contracts showing joint occupancy and/or ownership of your communal residence.

3. ..........................................

Ohhhhhhh... the government has NO problem invading the personal lives of individuals or taking freedom away in many regards.... thank god I am not poor and know I have the option of EC, BC or anything else I damn well please... ok that just took it to another level that I wish not to instigate... check out Bush's recent ruling on what physicians federally funded are able to NOT tell patients now if you're interested with where I was going with that.... I digress.

Perhaps you two could just chop off a limb as evidence that you'd really just do anything to be together. A limb would likely suffice.

I'm sorry. I'm snippy lately. I need to change my attitude.
