Hi all

I am totally new .

Still confused over the forms.

I have a US boyfriend who is station in Philippines.

We are planning to visit his mum in US next Jan 09 . Before that , he will come to Singapore to visit my parents first.

I want to know can we register our marriage in Chicago or Singapore first ? Or we need to get the visa done first ?

Coz we are not moving to US till mid of the year.

Any advise which way is better ? we want to have our children soon.

Thanks

1. are you legally married yet?

2. did you apply for any type of visa yet? eg. K1, K3, CR1,etc...

3. if you didn't apply for any visa's, you can't just move here whenever you want...

Hi

No , we are not married yet .

Thats why I want to find out what should we do first.

thanks

A K-1 visa (fiancee - i.e., not married yet, but planning to) is easier/faster to get than a K-3 visa (already married). I know that doesn't make a lot of sense, but it's a fact. So, it may make sense for you to hold off on the marriage and go for the K-1 visa.

you should research more on the visa to see which one is right for you. i'm not telling you how to run your life, but you should probably hold off on the decision to have a baby, a baby will probably make things more complicated during this process..

It might be better to hold off on a wedding for now.

What symbiosis said is true. If you get married (wherever) and file for K3 visa, you will still have to submit an I-129F on top of the I-130, so might be just easier to do the I-129F (K1) and not get married until you enter the United States. Either way, you would have to be in your country of residence for your consulate interview.

Hope that helped!

Hi sunny island, welcome to VJ.. the forms are indeed confusing, but you came to the right place to learn all about it. first things first is by familiarising yourself with the diff types of visas, infos abound on VJ here.

And as what the others have already mention to you, this visa process will take much longer than just a couple of months. Perhaps you can start filing for a K1 visa (fiancee) after your January visit to see his family. But make sure that the immigration can see that u do intend to go back after that visit, or else if they see u have intent to immigrate during that entry, that might be very bad for you coz they might turn you back.

Whatever your decision is (fiancee:K1/ spouse:K3/CR1), make sure you both read up info before hand, and by the time of your trip to US in Jan you can start gathering lots of evidence of relationship from before and current, as well as start do the paperwork already. the faster u move, hopefully the faster you get the visa and the faster you get to move to the US with your fiancee.

Good luck

Go thru all of the guides, they tell you about each way of filing, K1 of K3 or CR1...go thru them with your fiance, and then decide from there.
