NVC Has Not Received Case...

Hi,

My fiancee and I had a I-129F Petition case that was filed with USCIS January 26, 2006. It was approved by the CSC April 17, 2006, and I received a notice by mail and e-mail letting me know it was sent to the NVC. As of June 16 it has not been received by the NVC. I am alarmed at this... when I have called them (several times) they simply say that they know the receipt says 2-4 weeks, but it can take up to 90 days. Should I wait the whole 90 days or assume something might have happened to our papers? From what I have seen on this site, it should not take anymore than about 3 weeks for them to receive it, but it has been almost 2 months...

What do you suggest? Should I consult a lawyer to get involved or should I just be patient and wait the 90 days?

  • To say that my Fiance and I are in EXACTLY the same boat would be an understatement.
    Our timelines are nearly identical!!!
    (p.s. I'm sure you meant June 6, not June 16. That's ok.)
    Many people here might tell you that having the US Citizen of your couple contact their congressperson might help speed things up, but that otherwise you will have to wait out the full 90 days, before NVC will take any further action. (Today is the 50th day since NOA2, so we are more than halfway there.)
    At least we are not alone in this situation.

The fact that you and I have the exact same NOA2 date actually makes me worry less, because maybe we were the first approved petitions to go into a newly-started bin, and they are working their way very slowly to the bottom.
I would like to believe that we will both be hearing something very shortly, probably both on the same day.

January 19 2006 I-129F sent to TSC (Day 1)

- (Subsequently transferred to CSC)

January 27 2006-NOA1 (Day 9)

January to April - Tried to keep her patient and calm as we waited!

April 17 2006 - NOA2 (Day 89)

... 91 days ...

July 17 2006 - NVC ~ After 91 days, FINALLY received by NVC! (Day 180)

July 21 to August 8 2006 - Flew down to visit Amber in Florida (ZERO problems at border)

Jul 25 2006 - Packet 3 received

August - ABANDONED PROCESS

Although not the same but quite similar. Our k-3 case was approved on 4/13/06 and is yet to be received by the NVC. They've also mentioned to wait until the 90 day mark before they can provide me further instructions.

Good luck to both of you. Hopefully we all hear something positive soon.

6/19/06: Rec'd letter stating that inquiry was made to both NVC and USCIS regarding status of my petition

6/21/06: Travelled to go see my better half (boy was I excited)

7/3/06: Left my love once again (hopefully we shall see eachother soonest)

7/10/06: Followed up with congress person

7/10/06: Notified case was sent to the wrong place (go figure...how does it take 90 days to push paper from one location to the next) and has now been forwarded to NVC

7/18/06: NVC received case and has now issued a case number

7/20/06: NVC forwarded case to embassy

7/28/06: Lagos embassy confirms receipt of case into system

8/1/06: Pick up packet 3 and 4

8/25/06: Interview Date

We have almost the same situation. Our K3 was approved on March 20, 2006 and we haven't heard anything yet. After contacting a congressman we learnt that our petition has never left the building!

Skybri, I would recommend you to involve a congressperson, cause we were told that once an inquiry is made by the congressperson, they have to go physically look for the petition and get back with an answer.

Our lawyer faxed our approval to NVC 2 months ago, and nothing had happenned. We were told by the USCIS to overnight the approval to NVC ourselves, which my husband did...guess what? still no result...

right now we are trying to get USCIS resend the petition to NVC through our congressman ...we hope to hear something soon.

I see it was finally received on the final day of the 90 days! GOOD! Was it because of your congressman and lawyer being involved?

We were lucky to have a professional case worker at the congressman's office. She's probably called USCIS 10 times before they resent the approval to NVC .(It took them 5 weeks to resend it) Our lawyer hasn't done anything, saying that if the congress is involved there is nothing they can do other than waiting.

Have you contacted your congressperson? What USCIS says about your petition?

I hope you hear from NVC soon and this nightmare will be over, once and forever!

Good to hear it finally worked... do you have a copy of a form letter I could send to my congressman? Did you contact the congressman via a written letter or phone or e-mail?

Actually, the office of our congressperson happenned to be very close to where we live. So, my husband just called and made an appointment. After they had all information, he's been regularly calling them or stopping by their office whenever he could...

One thing we learnt is that you have to be more aggressive when working with government officials, I mean you really need to keep calling and reminding about the case.

I would recommend calling rather than sending a letter, it proved to be more effective in our case.
