Hey,

It looks like I did something really stupid.

I'm trying to get Green Card for my wife. (I'm US Citizen). She is already in the USA.

I've send only i130 with G-325A, but I did NOT include i-485.

Application is already "pending".

Now, here is my question:

Can I just send i-485 to the same address, with some cover letter explaining my mistake?

Will they accept it?

I've tried calling INS but it seems there is no way to get to a live person.

Not a mistake BTW... but yes you can just simply include the NOA for the I-130 filing as proof of a pending petition.

u have to wait til they send u the RFE letter.. IMO..

u have to wait til they send u the RFE letter.. IMO..

They will not send a RFE, they will treat the I-130 as a stand alone application. You need to send a copy of the NOA1 for the I-130 with your application for AOS and mail it to the Chicago Lockbox address.

btw. I have just one more questions. Are the processing times posted on uscis.gov real?

I know that my friends year or two ago were able to get green card within 3 months. Do I really have to wait up to a year to get GC for my wife?

Some have waited 3 years.... with 4-6 months being more typical, however, since this is a adjustment from other than a "K" visa, you WILL have a interview at your local USCIS field office and therefore the timeline is difficult to assess....

Depends where you live and how many cases your local office has , don't trust uscis site their dates are most of the time way off(...see my timeline below for an average of how long it might take

July 28.......Received Biometrics appointment
Aug 12.....received RFE notice

Aug 13...Biometrics Appointment

August 19...RFE received, case resumed processing
Oct. 8.........EAD Card production ordered

Oct. 16.......EAD Approval noticed mailed
Oct. 18........EAD in hand (came in mail)
Nov 3.........Interview Notice received in mail
Dec 4.........Interview APPROVED, CRIS email: card production ordered
Dec 9.........Welcome noticed received in mail Dec 9.........card production ordered
Dec 14.......Received greencard in mail

CITIZENSHIP (2014):
May 7...Application mailed out

Hi Mario,

well in california it took us exactly 7 months to complete the "whole enchilada" from application to approval, hence, once we filed the I-130 we only got a confirmation of being processed nothing more, all subsequent letters where form I-485. interview was a quick 10 minutes which was to confirm what was in the form, no additional info. was requested from us.

Agree with an above poster. Seems like they are making a progress lately though.

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

01/02/2009 EAD received

02/12/2009 Interview APPROVED!!!

02/23/2009 GC received!!! yay!!!
