What do we mean when we say to upgrade I-130 of spouse after petitioner became citizen?

Hi everyone,

Can anyone help me out on what's the fastest waiting time as far as you know in bringing spouse here in US with a pending I-130?

I am a green card holder.

I have a pending I-130 case for my wife that I think we still have 1 yr and 3 months of wait as of this time before we can get a visa number available.

I applied for naturalization last month of October 2008.

Which is faster? Shall I wait (1 yr, 3 months) for the visa to become available? or shall I upgrade my wife's I-130 once I become a US citizen (which I just applied October 2008)?

If you think upgrading her I-130 is faster, what form/s or application will I use the fastest? Shall I apply another I-130? K1/K3, IR-1CR1? I have little idea on these and how to apply it on my case. Don't know what route to take the fastest. Any help is truly appreciated. Thank you.

For upgrading you can call USCIS and tell them that you are a citizen.Also mail them a copy of ur naturalization certificate with a cover letter requesting to upgrade ,also include a copy of your NOA1.I upgraded mine on 24th oct and I had filed I-130 in March,2006.... still no approval :(.Since you had applied last month so i think it is still gonna take a while to get approved so you might want to go for K visa.Check the pros and cons in guide section.you don't need another I-130.

In order to upgrade your existing I-130 case for your wife, you should have your certificate of naturalization in your hand.

Since you applied for N400 on October, it will still take a couple of month.

After you receive the certificate of naturalization, you can send cover letter for your request along with the copy of your certifcate of naturalization.

Since your case is already approved you will only call NVC.I didnt apply for K3 yet I am just waiting for approval so I can go fo IR1/CR1 directly.There is no additional form or fee for upgarding.I upgraded mine @VSC but I suggest you to call NVC once to confirm their requirments for upgrading,According to my understanding, you wont be eligible for K3 as you dont have a pending petition any more,as it is already approved.

Hello dcjsjd, you will not be able to file the I-129F for the K-3 until you are a US Citizen, so it would then have to be approved, your wife will be here before then. When you get the natualization certificate, you can upgrade you I-130 for the spouse of a PR, to an I-130 for the spouse of a US Citizen, no more waiting, then your petition will be processed at the same speed as the other US Citizen I-130's approved at that time. Yizhen ni hao? :D.. thanks for the info. Is upgrading I-130 of PR to I-130 of USC the same as IR1/CR1? I don't need to worry about K3 right? So all i need to do is once I become citizen just call NVC to upgrade then they'll just mail me instructions on how to process IR1/CR1(I-130 of US Citizen upgrade)? So this is the quickest way huh as far as my case is concern? once again, zhe zhe ni ;)

I'm sorry for the delay, the answers are yes,yes, and yes. We are in Florida with the family gathering to celebrate my father's 90th birthday. Yesterday he drove to the airport to pick-up my sister. What route did you take? did you go for K3?

With an I-130 already approved, K3 is no longer an option. An I-129F for spouse can only be filed when the I-130 is still pending. You are on the IR1 visa path.

What route did you take? did you go for K3?

With an I-130 already approved, K3 is no longer an option. An I-129F for spouse can only be filed when the I-130 is still pending. You are on the IR1 visa path.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

wow that's way too fast, the quickest one i've heard so far, some 5, 6 and 8 months time... but 1.5 month? their processing system is perplexing.
