Hello VJ's,

I would like to know for some clarifications. I hope you can give me some ideas.

If you are legally married here in the US does it mean that the wife also owns the assets/properties of her husband even if the wife's name is not in the property ownership? example. .If the couple bought a house but just in the husband's name..does it mean the wife also owns it since they are legally married by the time the property was bought? Does it really have to be in both names? or it's ok even if the property is just in the husband's name?

Your inputs would be appreciated.Thanks so much in advance.

It depends upon the state where he lives. Where I live during my divorce proceeding the house would be propoerty that we both owned since we post it after we were married. It does not matter that I was listed on the deed only. Then after the divorce we had to file a quite claim deed that changed me from Married to Single. At that point she could no longer claim the property as joint ownership.

What the husband and the wife bring into the marraige would be their property and are theirs if it ends. What is acquired while married is usually joint property, although, like someone said above, that can depend on which state you live in. Also, anything that is deemed sole property of one person or the other can be hammered out in the divorce decree as shared or going to the other person.

A house, even though in his name only, is usually considered joint regardless of who's name is on the title. That could be good or bad, depending on if money is owed on it at time of divorce.

Thank you guys for your reply although am still a lil bit confused. I live in Georgia . Were not planning to get a divorce since we are happilly married..just was curious about the conjugal properties that me and hubby have acquired since we got married. I would appreciate if you can give me more info or website for me to read regarding this.Again thanks and God bless you all.

If, heaven forbid, one of you passed away, the other has right of survivorship due to the marriage whether the name is on the deed or not. My name is not on our house deed mainly because Georgia is a joint property state and we didn't want to pay extra to get a document that says what is already in effect by law.

My husband purchased our house before our marriage. If we divorced it would be considered marital property and would be addressed during a divorce settlement (we aren't getting divorced, btw :-) ) as Georgia is an 'equitable distribution' state. From my understanding, if he passed away, the house becomes mine as we are 'joint tenants' married to each other and living in the house together, and either spouse has right of survivorship for the other. I am not a lawyer, however, so we have also addressed this in our wills, making each other our heirs just in case we mis-understood the law, or there is a change in law, so that my interests in the house are protected.
