Fiancee holiday visit, need PoE advice

Timeline

So next Wednesday my Fiancee arrives for the holidays. This will be her first visit during the K1 process. What exactly should she say at the PoE? We want to be honest, but I have read of people being turned away once they mention a visit with a fiance. Should she not mention me at all and simply say she is visiting friends and family?

Also, any tips on evidence she can bring to prove that she has a "connection" to her home country would be very appreciated.

Friends and family for the holiday's is pretty standard. My husband brought a letter from his employer stating when he was due back, a letter from his uni, a bank statement showing he still had an account and the return ticket with. He was pretty much waived through, so hopefully it will go was well for you guys!

Mailed AOS, EAD and AP Sept 11 '07

Recieved NOA1's for all Sept 23 or 24 '07

Bio appt. Oct. 24 '07

EAD/AP approved Nov 26 '07

Got the AP Dec. 3 '07

AOS interview Feb 7th (5 days after the 1 year anniversary of our K1 NOA1!

Stuck in FBI name checks...

Got the GC July '08

Apparantly they do not have a record at POE that you have applied for a K1

I am going for Christmas and will say I am going to visit my boy, and if they ask more I will not lie I will tell them the truth

Last time I visited the states all they asked to see was my return ticket, although I did have a letter from my employer saying that I was on holiday and the day I was due back at work which I did not show

I would take a copy of a lease or motgage and anything that you have that show ties to the home country

My fiancee does not currently have a job, as I am supporting her till the visa. However, she will have bank statement and return ticket (or at least E-ticket/Itenerary) in her hand.

I'm just going to tell her to be completely honest, and see how it goes. We have nothing to hide, and I cant imagine NZ is really high on the threat meter. :P

I want to stay with my fiancé in US during this k1 visa process. We are almost half way there.

How would you explain this to customs officer?

Visiting friends and family IS completely honest. If you mean you want to test what happens when she says, "I'm visiting my fiance." be prepared for her to be escorted to the next flight home without ever seeing you. That might not happen but be prepared for exactly that particularly if she has no job.

Facts are cheap...knowing how to use them is precious...

Well, my Fiancee comes next week on the 12th, and I'm suddenly having doubts about her gaining entry to the US. After reading as many posts as I could about the PoE experiences etc, I'm pretty sure she will be turned away.

She is going to have a letter from her Landlord stating that her room is being held for her with all her belongings. She is going to have a letter from her mother stating that she expects her back, as well as bank statements, credit card statements, and of course her Return Flight information.

However, she spent the summer with me (80 some days), returning to NZ 3 months ago, and this visit is for 80 days (the entire holiday season.) Also, she has no job. From what I can gather, those two things will cause her to be denied entry.

Is there anyone out there who made two 3-month visits to their loved one in the same year?

I hope I am wrong, but my confidence is broken.

(Also, will it hurt our K1 process if she is denied?)

Firstly it will not gurt your K1 if she is denied.

This is a tough one, the problem is that she has to has to have spent more time in her home country than the states and she has spent more time in America than her home country this year.

I do not know how to advise you on this one, there is a chance she will get turned back you have to weigh up if it is a chance you wish to take

It depends also on who you get a POE, but with her spending so much time in the States and no job I think they would look into it further

Hoepfully someone will come along with more experience and give you more solid advise than I can

We spent more than a year coming in and out of the US every 90 days so I feel your concern.

Unfortunately, nobody can tell you what is going to happen at the POE. I think you are as prepared as you can be but it seems that they are getting much more stringent because of so many taking advantage of the VWP.

It's important that she tells the truth but does not offer more information than needed. Of course, if she is asked, she should tell the truth about you and about her intentions in the US. Seems likely they will ask if she spent the summer here. Perhaps even bring a copy of your NOA1 so they understand that you are going about this the legal way and just want to spend time together. Again, bring it out only if things start to get steamy. ;)

ESTA is voluntary until Jan '09 but i'm not sure i'd risk that at this point.

good luck... i agree, it's an awful long way to travel to get turned away. Perhaps have a backup plan in another Country just in case?

Also, it will have no effect on the K1 unless you/she breaks the law. Russell was turned away in Sept 07. The only issue he had was that he was still on the 'watch list' when he entered the Country and needed to wait about 20 min for them to clear that up.

Saying that my fiance and I are going about things the legal way was one of the main reasons my (last) visitor visa was denied. It was not at a POE, though, but the Embassy here in Zagreb. Still, the CO himself nodded his head when I asked if one should, actually, avoid being honest, since that seems to hurt you more than it could ever help.

However, yeah, Croatia is not a part of VWP. At the same time, isn't a high fraud country either. Visas are granted as the COs please, based on nothing in particular, other than, perhaps, that day's weather forecast.

Yes, I agree, it has everything to do with the person asking. That's why I said checking with the ESTA might not be a good idea as it just adds another factor.

But I still say that if you're already being questioned (at POE) about your fiance (in case they mentioned it anywhere...etc) then it's always best to tell the truth. Misrepresentation is a far bigger offense than is being 'allowed to withdraw your petition to enter'. ;)

I'm going on the 11th (December) so in less than 5 weeks!
