I-130 Outside Processing Dates

Man I'm in the same situation. From senators office I was told that they have started background check, and was told not to inquire for 3 months. But every time my wife would try to call USCIS they would not let her talk to the officer. So what is the trick to make that happen. And when you did talk to the officer, you just explained the situation and they sent the letter to CSC?

I've heard that these background checks take forever in some cases. In my case i lived in states for 8 years and dont have any criminal records. So really hope it won't take too long. So I would also try to do anything to speed it up at least a little but and not to get stuck in there forever some people do.

Well Senator's office hasn't even gotten back to me yet nor did the other congressman get any results for me. I initially called to say look my case has been transferred and I understand the rule is after 90 days we should have gotten feedback. Keep in mind im speaking to a representative who's a contractor who probably has no idea what she's talking about. When she checked my record and it sounded like it got approved I told her well how come I haven't received any approval notice or my status hasn't changed. Since she didn't have an answer she transferred me to an officer. Well agent wsan't able to help much since the system went down. Second time I called explained what happened and told her that I was told to call back and ask to speak to an agent regarding my case. She looked into it, and probably realized she couldn't get any other details and decided to pass me to the officer.

Suggestion just tell them its been transferred and you understand the rule is in 90 days there should be some action. Now if your case shows that its in back ground check ... maybe they won't transfer it. Try saying i was told to call again and speak to an agent next time i call. see if that works :)

Thanks man for the detailed answer.

One question I have is why they won't let my wife to talk to the officer. The talk about some f@#$ing service request and we have to wait for like 30 days to hear about the case. She told them that we are outside of processing time and things like that, but no use. They said that service request is the procedure they have to follow, and they can't transfer us to the officer. We tried calling several times today.

Timeline

We finally got the i-130 approval!!! Now we have to wait for instructions from NVC. The Congressman....Senator thing didn`t help a bit. USCIS deals with things the way they please....they told our congressman we were in FBI background check and that they couldn`t give him any information when in reality they didn`t like my husband`s birth certificate, which he's been using all his life, including to enroll for military service and had no problems before now. We waited over a year just to be told they needed another copy. Anyways...Hubby got another birth certificate from his hometown, sent it to them and all is fine. I hope NVC will be smoothe sailing.

We got married on September 7th 2007 after dating for 5 years and sent in the paperwork for I-130 in October 2007. Vermont Service Center acknowledged receipt January 15th 2008. Our application was transferred to the California Service Center in August 2008, 26th I believe. To this day, still no answer. We are held in total darkness.

The processing dates for the California Service Center are now within 6 months according to their website. We are way behind in the process, way outside processing dates. I (Julie) am getting very discouraged, I can`t stand not knowing if I`m coming or going anymore. As far as I can read in the forums, people who filed after us are already approved and moving along. Anyone else in the same boat as we are? Any idea on what can cause such a delay?

There's a number you should be able to call a number if you are outside the processing times. Granite their processing times on their website aren't very accurate.

I was outside the timelines to and was very frustrated.I tried my comgressman and senators with no help. I call the white house and they put me in touch with the state department. my paperwork was approved the next day. it is worth a try.

Thanks aba! I think it will be more than one month, still waiting on instructions for the medical and police clearance. But at least now, it's moving along!
