I am helping a friend fill out his K1 Petition after having done one for myself in 1999 and another for a friend in 2007.

I was wondering if there is a different format if the Petitioner is in the US Military?

Also one concern of his is, what happens if he gets deployed while this process is taking place? Being that this could happen in 2009.

He is just getting ready to fill out the I-129F along with all other needed info.

Form is the same...

If he is being deployed he can then try to request expedited service....

If he is being deployed he can then try to request expedited service....

Correct, only other difference is the affidavit of support requirements are a bit lower for military, 100% instead of 125% povertyline.

Affidavit of support is needed at the time of visa interview, as well as when adjusting status.

Dont put tooo much hope in this. My fiance is active military and we have been waiting for a month. We know other active mil. people who has been waiting for longer, so we fully expect to be waiting the full 4 to 5 monhts. (fingers crossed)

Ofcause if any of that changes I will keep everyone here informed.

Yup. There is an unwritten rule about expediting cases of military personnel. All he has to do is request for an expedite form. :)

I put in an expedite request on the 11th of September. No dice apparently :wacko: It was frustrating getting all the documents ready only to get the cold shoulder when I called in and inquired on it. I don't know why it wasn't approved or if they even got the documents lol. I sent them two ways.

Strange, my wife used to work in the US Veterans office in Manila, and it was an unwritten rule for them at the time. May it only applies to Manila?

We requested for expedite as well since my SO is in Iraq but they didn't get back to us yet...so we will just try to send a fax this time and cross our fingers...my feeling is that VSC grants for military expedite faster and easier than CSC...of course we're at CSC...

Not sure about that. My fiance is active military but because he is not on deployment (even though he is in the middle east) he is not eligable for an expedite.

Not sure about that. My fiance is active military but because he is not on deployment (even though he is in the middle east) he is not eligable for an expedite.

For what I know they need to be on deployment orders to be expedited...and even in that case its not 100% sure they will accept the request. They told us they were going to send us an email in 7/10 business days and its almost 3 weeks we request it but we didn't get anything yet so it makes me wonder whats going on and if it is so true that they give military expedite so easily.

Thank you very much Laura+Tom...what happened is that we called USCIS regoular number because we didn't get our NOA1 hard copy so he called and asked our case number...after that he asked to expedite our case and they passed him the military line...he said the guys just asked him what the reason were and than he told him that the process was going to be expedite, just to wait to hear from them in 7/10 business day and keep our paperwork handy...oh well, we have them handy...hehe! Only thing that make me wonder is that they didn't gave us a other number to track our expedite request so I don't know...But we have hope! :yes:

Hope you hear from them soon. Tom just told me was talking to a senior officer about our petition and the officer told him to call and see if he could get a expedite. We don't think we'll be allowed but it's worth seeing if we are.
