can i work right after getting married?

Timeline

i am licensed U.S. registered nurse after having successfully taken the NCLEX exam while i am still here in the philippines. i leave for the US this november and my fiance and i will be getting married on feb 2009 after he comes home to the US after his current deployment. will i be able to work right away while processing the AOS? or do i have to wait for my green card?

i read the general FAQs posted by captain ewok on AOS, EAD and etc. but it's quite technical and difficult to understand. it would be very helpful if someone will help me by laying out the details in a less-technical manner as possible. thanks!

K1 TIMELINE

04.08.08 - i-129f sent to vermont

04.10.08 - i-129f NOA 1

05.15.08 - i-129f NOA 2

05.20.08 - NVC received

06.10.08 - medical exam, paid for document verification

06.17-19.08 - needed to go back for sputum exam

06.19.08 - scheduled interview (POSTPONED due to sputum exam)

07.08 - my fiance's deployed to russia

08.26.08 - 2nd medical exam completed at st. lukes, NEGATIVE SPUTUM EXAM

08.29.08 - interview at USEM (with PINK SLIP!)

09.03.08 - at 3pm, USEM released passport for delivery - accdg to Delbros' website

09.06.08 - US visa in my hands (with 11.15.08 as expiration date)

01.30.09 - date of marriage

02.04.09 - sent requirements for AOS

02.06.09 - requirements received by USCIS

02.10.09 - notice date for biometrics

02.24.09 - BIOMETRICS SCHEDULE

You can work when you get your EAD - typically this takes around 90 days once you file. You do not have to wait until the green card but getting married does not authorize anyone to work. :thumbs:

you can work... the question will be can you work legally... You are not legal to work until you have received employment authorization... either via one of three ways...

1) for 90 days after entry if you recieve the "authorization stamp" at the POE

2) After your I-765 is approved (for 90 days if applied before AOS application, or one year if included as a part of your AOS application)

3) After you receive greencard

You can work when you get your EAD - typically this takes around 90 days once you file. You do not have to wait until the green card but getting married does not authorize anyone to work. :thumbs:

60-90 days, so that is why option 2a (before AOS) does not make sense for most... $340 and no guarantee you can use it at all....

you are most def right! so i guess i just have to do the option that i will mail my I-485 and I-765 together. and spend the 60-90 days enjoying my hubby.. :lol:

Best option - get settled in - get familiar with the layout etc. Get some other things going (like social security card/number etc)... plenty to do in the mean time. :thumbs:
