Hi all

I hope you can help me.

I had an abortion on the hospital when i was 16, I was 8 weeks pregnant, and I got a medical abortion and everything went well.

Now I just read that they might deny me the visa because of this in another thread? I dont understand what does an legal abortion have to do with getting the K-1 visa?

Maybe I'm the one who has misunderstood something, but i never heard of it before, and i can't seem to find the reason why it would possibly make me uneligible? I never thought of it.

I really hope you will respond me, because i have read alot about this process and K-1 visa before we started and I NEVER heard of this.

11/11/2008 - NOA1

03/09/2009 - RFE received

03/11/2009 - Returned RFE

05/23/2009 - Recieved 2nd RFE

08/05/2009 - Denied. Besides that he turns out to be a total jerk. Case ended.

NVC JOURNEY BEGINS

4/07 NV Case number assigned

4/08 AOS, DS and all fees paid online

6/09 tax transcript for 2007 just became available -whoot

6/20 NVC receives everything nothing more to give them now just close eyes and pray

6/23 NVC enters into system

6/26 NVC - RFE uggh - wants all three years of Federal tax return listed and they lost originals or so they say - DING DING ROUND TWO

7/25 NVC Case completed whooottttttttt

8/7 Case forward to US EMBASSY LONDON OH YEAHHHHHHHH -

Embassy - case out for delivery to embassy via DHL sneaky us lol

08/10Received

08/19 Medical Exam completed - healthy oh yeah!!!!!!!!

9/26 @8am -Interview - approved VISA IN HAND OMG WHOOT!!! HELLO AMERICA MY LUV

POE- Atlanta then MCO - October 15th with the cat "GIT" on board lol - POE SUPER SWEET

Husband home finally - god what a journey....but after 400+ days we made it

There are/were no facts in that thread. As long as Ive known - abortion is not and has not ever been a reason for denial. :thumbs:

I think the poster meant that she had to go for psychiatric testing BECAUSE of the abortion and was worried that this will be a factor for denial.

You wont be denied because of an abortion. :)

Section 212(a) 1 indicates psychiatric problems that poses a threat to self or others are inadmissible.

(I) to have a physical or mental disorder and behavior associated with the disorder that may pose, or has posed, a threat to the property, safety, or welfare of the alien or others, or

(II) to have had a physical or mental disorder and a history of behavior associated with the disorder, which behavior has posed a threat to the property, safety, or welfare of the alien or others and which behavior is likely to recur or to lead to other harmful behavior, or

(iv) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to be a drug abuser or addict, is inadmissible.

I'm aware of that.

We're talking specifically about the abortion, not the psychiatric testing.

That thread contains an absolutely HORRIBLE and INACCURATE response, not to mention against the Terms of Service at Visa Journey.

No one should suggest that ANYONE make false statements to the government.

My response to the thread is...

As YuAndDan posted, Abortion is NOT a grounds for visa denial.

Also, the presence of a psychiatric evaluation on it's own is NOT a grounds for a visa denial.

The outcome of the psychiatric evaluation "could" be grounds for a visa denial, and will vary by case.

This is a forum where giving bad or inaccurate advice/information is much worse than being silent.

If you're not absolutely sure and accurate about information, please do NOT post it here.

You're dealing with peoples lives and hearts. This is not a knitting forum where the result of a bad post can easily be fixed.
