ok,

i just read this article .

i am a us citizen and my fiance is canadian

we are working on filing 129f

she has been in US before to tour and such

should we skip 129f and just get married in the US? but don't the US Govt frown on that ?

or do we get married outside US....then come in and then do paperwork ? she can be in US while we wait on paperwork right ?

thanks for your help and patience with my questions.

We don't call it the misinformation line for nothing. To enter the US from Canada with the intent to marry and immigrate by adjusting status based on that marriage is visa fraud. Since you already have intent to marry and your fiancee is currently in Canada, the K1 visa is the appropriate and legal path.

If your fiancee is in the USA now, and your decision to marry occured after she arrived, she may simply stay, get married and adjust status. If you go that route, she must remain in the USA until she has her green card in hand.

If you decide to marry outside the USA, she may remain in the US for up to six months if the CBP officer grants her entry. There's no gaurantee of entry for anybody under any circumstances.

I visited the U.S. numerous times while our I-129F was being processed with no problems (by car, not plane). I always made sure I had my proof of ties to Canada with me, though.

Make sure your fiance always has her most recent pay stub, lease/mortgage documents and any other proof of ties to Canada every time she visits you and you shouldn't have any problems. There is never any guarantee, no matter how much proof you have, that anyone will get admitted into the U.S. It is completely up to the discretion of the border officer.

I was asked once if I had heard of the Fiance visa, and I replied that yes, I had, and that we had submitted it and were just awaiting our approval. I told the border officer I was simply going down for a visit to see my fiance.

She may try and will probably be successful but there is not gaurantee of US entry for any foreigner under any circumstances including with a visa. Entry is decided on the spot by a CBP officer.

I think it i horrid that even after they have a fiance visa approved THAT it STILL can be denied on entry. IF they have the visa after all those long months and interviews, test YOU name it; THEN it should be a *welcome to the USA, not a Well so what you got a visa who cares, treat you like ####### at the gate thing.

07/17/08 Arrived and picked up by CSC

07/25/08 NOA-1 FINALLY!!!!

07/31/08 CHECK WAS CASHED!

07/28/08 touched!!

12/08/08 NOA2 FINALLY!

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Venting is ok but what you think might be horrid is only likely to happen if there's a good reason. If it does, one would feel like ####### no matter how courteously they were treated.
